SUMMARY RECORD OF THE FORTY-FIFTH MEETING

held Lausanne on Saturday, 6 August 1949, at 10.30 a.m.

Revision of the preliminary draft for an international regime for the Jerusalem area (Com.Jer.W/18).

Following a suggestion from Mr. BARCO, the Committee agreed to request the Secretary to prepare a single draft which would seek to reconcile the existing draft for an international regime for the Jerusalem area with the amendments suggested by the French and United States delegations, phrasing articles on which agreement had been reached in acceptable legal form and including all points on which differences of opinion existed. The Committee would therefore adjourn until the following Wednesday, 10 August, when it would begin discussion on the draft prepared by the Secretary.

Working paper prepared by the Secretariat on the control of religious Properties (Com.Jer/W.28)

The Committee decided to transmit to the General Committee, with a covering note, the working paper on the control of religious properties which had been prepared by the Secretariat.

Russian Orthodox Properties

Mr. BENOIST suggested that the Committee Secretary be requested to obtain further information on the question of Russian Orthodox properties in Jerusalem once he had completed the more urgent task of preparing the compromise draft for internationalisation of the Jerusalem area.

The Committee agreed also to a suggestion made by the French representative to postpone consideration of Article 8 until Article 7 had been discussed since he considered the powers of the International Tribunal would vary according to the extent of the authority attributed to the Council provided for in Article 7. Moreover, the Committee Secretary informed the Committee that he would then be in a position to supply further information regarding court procedure in Palestine.
