1.    Action taken by the Committee on the Exercise of the Inalienable Rights of the Palestinian People

At its 68th meeting held on 12 August 1981, the Committee accepted an invitation extended by Chairman Yasir Arafat of the Palestine Liberation Organization to send a delegation to visit Lebanon to assess damage caused to the Palestinian refugee camps by the Israeli attacks during the month of July 1981. The report of the visit is reproduced below.

The Chairman of the Committee addressed a letter to the Secretary-General and the President of the Security Council expressing deep concern caused by Israel's actions in Jerusalem where excavations are continuing in a tunnel located underneath Al-Haram Al-Sharif (the Holy Mosque). The full text of the letter is reproduced below.

On 14 September the Committee held a meeting in which its report to the General Assembly was approved. The Committee recommended that the General Assembly should urge the Security Council to take positive and urgent action on the recommendations of its report relative to the problem of Palestine.

At the same meeting the Committee heard an oral report by its Chairman on a visit by a delegation of the.Committee to the Soviet Union at the invitation of the Soviet Committee of Solidarity with the countries of Asia and Africa from 3 to 7 August 1981.

On behalf of the Committee on the Exercise of the Inalienable Rights of the Palestinian People, I should like to convey to you the deep concern caused by Israel's actions in Jerusalem, where excavations are continuing in a tunnel Seated underneath Al-Haram Al-Sharif (the holy mosque), despite the assertion by a spokesman for the Israeli Minister for Religious Affairs that the digging had been halted.  The work being done in this tunnel is endangering Islamic buildings adjacent to Al-Haram Al-Sharif and the continuation of this excavation work can only fan tension in the Holy City.

There have apparently already been some skirmishes between Arabs and Jews about the excavations and it may be expected that tension will mount unless work in the tunnel is halted immediately.  The Committee is of the firm opinion that urgent action must be taken to make Israel clearly understand the dangers of continuing the work without taking the Arabs' religious feelings into account.

REPORT OF THE DELEGATION OF THE COMMITTEE ON THE EXERCISE

OF THE INALIENABLE RIGHTS OF THE PALESTINIAN PEOPLE ON ITS

VISIT TO LEBANON (24 to 26 August 1981)

1.  In response to the invitation of His Excellency, Mr. Yasser Arafat, Chairman of the Executive Committee of the Palestine' Liberation Organization, a delegation of the Committee on the Exercise of the Inalienable Rights of the Palestinian People visited Lebanon from 24 to 26 August 1981 to see at first hand the extent of the damage done by the Israeli attacks in the month of July 1981.

2.  The delegation was composed.of H. E. Mr. Massamba Sarré, Permanent Representative of Senegal to the United Nations and Chairman of the Committee on the Exercise of the Inalienable Rights of the Palestinian People; H.E. Mr. Niaz Naik, Permanent Representative of Pakistan to the United Nations; H. E. Mr. Coskun Kirca, Permanent Representative of Turkey to the United Nations, and H. E. Mr. Vladimir A. Kravets, Permanent Representative of the Ukrainian Soviet Socialist Republic to the United Nations. Mr. Yogaraj Yogasundram, Chief of the Special Unit on Palestinian Rights accompanied the delegation.

3.  During its stay in Lebanon, the delegation was received by H. E. Mr. Salim el-Wazzan, Prime Minister of Lebanon; H. E; Mr. Yasser Arafat, Chairman of the Executive Committee of the Palestine Liberation Organization and H. E. Mr. Farouk Kaddoumi, Head of the Political Department of the Palestine Liberation Organization.

4.  The delegation also paid a courtesy call on Mr. Iqbal Akhand, Co-ordinator of United Nations Assistance for Reconstruction and Development of Lebanon.

5.  The delegation visited South Lebanon and saw the damage caused in Saida (Sidon), Nabbatiyeh and Sour (Tyre). The delegation also visited Camp Rashidiyeh and a Palestinian military camp in its vicinity. On its return to Beirut the delegation visited the Fakhani sector where a complete apartment block had been demolished during the Israeli raid.

6.  On its visit to South Lebanon the delegation was shown the extensive damage done by aerial bombing and off-shore bombardment to the Zahrani oil refinery, on the outskirts of Saida. A bridge on the main Beirut-Tyre highway located alongside the refinery had been demolished in the attack but had been rebuilt at the time of the visit, permitting traffic to proceed. The refinery had been partially destroyed, the main damage being done by bombardment from naval off-shore vessels. It was reported that there had been heavy loss of life and considerable damage to vehicular traffic as a result of the attack.

7.  In Nabbatiyeh the delegation met the area military commander of the Palestine Liberation Organization and was escorted to some areas which had been damaged by the Israeli attack. This area was reported to he under constant bombardment since 1978. The delegation was shown an orphanage which had been partially destroyed in 1978 and attacked again last month.

A visit was paid also to a refugee camp which had been abandoned due to constant attacks by the Israeli forces over the last few years.

8.  The main bridge over the Litani River on the main Beirut-Tyre road had been destroyed and reconstruction was in progress necessitating a detour. It was pointed out that the destruction of this bridge only inconvenienced the civilian population as military movements were in no war hampered by its destruction. Two minor bridges further up this river continued to handle vehicular traffic, though these are also subject to repeated attacks and have constantly to be rebuilt.

9.  In Sour (Tyre), the delegation was accompanied by the area Military Commander to various locations damaged in the recent attacks. It was noted that not even antiquities dating back to early Roman times had been spared in this attack.

10. A visit to Camp Rashidiyeh, situated in Hour offered the delegation an opportunity to see the living conditions of the Palestinian refugees in the Camp and the extent of the damage done by the Israeli attacks. The delegation was informed that this Camp was subject to constant attacks by the Israeli air force. The delegation visited the site of a school that had been razed to the Ground in the course of these continuous attacks. Damage done in the recent attacks was extensive, some 400 houses being completely or partially destroyed.

11. The delegation noted the which morale of the inhabitants of the Camp and the speed and determination with which the damage was being repaired. This was indeed a point noted in all areas visited.

12. The bombing and rocket attacks on the Fakhani sector in the heart of Beirut had resulted in the complete destruction of several hi-rise apartment buildings with considerable loss of life. The extent of property damage in this sector alone was estimated, at several million Lebanese Lira.

13. All damage caused by the attack in July, was as far as could be seen, entirely confined to civilian targets and appeared to be aimed at terrorizing the civilian population and destroying its morale.

14. Suggestions were made, in the course of the visit, that the Israeli attack in July had as its chief aim the creation of antipathy amongst the Lebanese against the Palestinians through the disruption of the economy of Southern Lebanon and through the terrorization of civilians both in the south of Lebanon and in Beirut.  If this was indeed the aim, little heed appears to have been paid to the high cost in civilian casualties that was bound to result in the means used to achieve such an objective.  In the absence of any other obvious reason for the attacks and judging particularly from the choice of targets, the delegation is inclined to agree with the suggestions referred to above.

15. Reference has been made already to the speed with which the damage done by these raids was being repaired. The delegation wishes to stress that it was deeply,impressed by the high morale of the civilian population it encountered during all its visits and the resilience displayed by it in repeatedly repairing, in some cases overnight the-damage done by continuous Israeli attacks.

16.  In its meeting with H. E. Chairman Arafat and Mr. Farouk Kaddoumi, and as well as with other Palestinian leaders, the delegation was constantly reminded that the Palestinian people were determined to attain their legitimate rights in Palestine.

17. Chairman Arafat, in his meeting with the delegation, analysed Israeli aims as follows:  the savage attacks were intended to divide the people against the Palestinians, to eliminate the Palestinian leadership and to ruin the economy of Lebanon, particularly the south of Lebanon, by cutting communications. He expressed his conviction that the aggression would be repeated and that, in fact, Israel was in the process of massing troops for a fresh attack. He felt that Israel was able to pursue this aggressive policy because of the military, economic and political assistance it received from, some states, particularly the United. States of America.

18. Both Chairman Arafat and Mr. Kaddoumi expressed confidence in the Palestinians' ability to withstand any attack that Israel could mount and also that the strong resistance which the Palestinians had been able to put up against the last Israeli attack had resulted, for the first time, in a major setback for Israel who could no longer claim that "there is no Palestine Liberation Organisation".

19. However, while the Palestine Liberation Organization was prepared to use all means at its disposal, including armed force, in order to obtain the inalienable rights of the Palestinian people, it had the fullest confidence in the United Nations and wished to achieve its objectives within its framework. This had been proved by its cooperation with United Nations bodies and in the maintenance of the cease-fire. Both Chairman Arafat and Mr. Kaddoumi expressed appreciation for the work of the Committee on the Inalienable Rights of the Palestinian People and stressed the need for the Committee's assistance in finding a peaceful solution within the United Nations' framework.

20. The delegation recommends that the Committee should take steps to have the report of the delegation circulated as a document of the United Nations General Assembly and of the Security Council as well as to include it as an annex to the Committee's report to the General Assembly.

21.  The delegation wishes to place on record its appreciation to the Government of Lebanon for having agreed to the visit of the delegation to Lebanon and particularly to His Excellency, Mr. Salim el-Wazzan, Prime Minister of Lebanon, for receiving the delegation. The delegation wishes also to express its gratitude and appreciation to the Palestine Liberation Organization for the generous hospitality it extended to the delegation and for the excellent arrangements made during the delegation's visit.

2.   Resolutions adopted at the Twelfth Islamic Conference

of Foreign Ministers held in Baghdad from 1 to 5 June 1981

RESOLUTION NO. 1/12-P

THE ISSUE OF PALESTINE AND THE MIDDLE EAST

The Twelfth Islamic Conference of Foreign Ministers held in Baghdad, Republic of Iraq from 28 Kajab to 3 Sha'aban 1401 H (1-5 June, 1981),

Considering the provisions of the Charter and the resolutions of the Islamic Conference,

Considering the resolutions adopted by the Third Islamic Summit Conference held in Makka-Mokarramah/Taif Session of Palestine and Al Quds Al-Sharif,

Reaffirming its commitment to the "Makka Declaration" the "Declaration of Holy Jihad" and the "Islamic Programme of Action to counter the Zionist Enemy",

Considering the U.N. Resolutions on this question,

Reaffirming that the liberation of the city of Al Quds, Al Sharif from Israeli occupation, the restoration of Arab and Islamic sovereignty over it so that it becomes the capital of Palestine in the context of the independent Palestinian State under the leadership of the Palestine Liberation Organization, and the liberation of religious Holy Places from the racist Zionist occupation are requisites of the Holy Jihad, which must be waged by all Muslim peoples and governments and in which they must participate, each within its own means and ability,

Reaffirming that the question of Palestine is the core of the Middle East conflict, and that the continued occupation by the Israeli enemy of the Palestinian and Arab territories, including the city of Al Quds Al Sharif and its continued denial of the inalienable national rights of the Palestinian people constitute a flagrant violation of the principles of the Charter of the Islamic Conference, the United Nations Charter, the Universal Declaration of Human Rights and international law,

Deeply concerned at the increasingly deteriorating situation in the region of the Middle East as a result of the continued occupation, by the Israeli enemy of the Palestinian and Arab territories, including the city of Al Quds Al Sharif which threatens a new outbreak of war, and jeopardizes international peace and security,

Believing that the time has come to apply the mandatory measures set in Chapter VII of the United Nations Charter against the Zionist entity, in view of its persistence in violating the principles of the Charter, its refusal to implement, and oven its continued defiance of the resolutions of the international Organization, its collusion with various aggressive, racist and expansionist regimes, its continued aggression against Arab countries, and its declaration of a war of genocide against the Palestinian people and the Palestine Liberation Organization,

Convinced of the need for Islamic States to adopt firm and practical action to confront the persistent aggression and continued violations by the Israeli enemy,

Stressing the declaration by Islamic countries of "Holy Jihad" to salvage Al Quds Al Sharif vindicate the Palestinian people and secure immediate, total, and unconditional Israeli withdrawal from the occupied Palestinian and Arab territories,

Convinced that the military, economic, political and moral support extended, by the United States of America and some other countries to the Israeli enemy encourages it to persist in its policies of aggression and perpetuate its usurpation of Palestine and other Arab territories,

Considering that the maintenance of political, economic, cultural, technical and other relations with the Israeli enemy also helps that enemy to perpetuate its usurpation of Palestine and the inalienable national rights of its people, to persist in its disregard of the will of the international community and the resolutions of the United Nations, and further encourages this enemy to pursue its expansionist, colonialist racist policy, ever and always founded on terrorism and aggression,

Reaffirming that the Racist, Zionist entity in occupied Palestine and the Pretoria racist regime in South Africa are organically connected, given their practice of racist policies which repress freedoms and violate human dignity,

I. DECIDES:

To implement all resolutions adopted by previous Islamic Conference on "the question of Palestine and the Middle East", in particular Resolution No. 2/3-P(IS) adopted by the Third Islamic Summit Conference in on Palestine and Al Quds Al Sharif ) and the two resolutions No. 1/11-P and 2/11-P adopted by the Eleventh Islamic Conference of Foreign Ministers, held in Islamabad;

II. To endeavour to secure the adoption of a new resolution by the Security Council that explicitly provides for the inalienable national rights of the Palestinian people, including:

– their right to return to their homeland in Palestine;

– their right to self-determination without any foreign interference; and

– their right to establish their independent national State on their own national soil;

III. To take all effective measures, on the widest international scale possible – at the United Nations and its specialised institutions and within all other international organisations and conferences – in order to:

1.  ensure the rejection of the credentials of the delegation of the Zionist entity to the United Nations General Assembly, given the fact that it represents an-authority contravening international legitimacy and claiming Al Quds Al Sharif as its capital

2.    suspend the membership of the Zionist entity in the United Nations and its Specialised Institutions for its continued refusal to implement the United Nations resolutions, and its sustained aggression against the Palestinian people and Arab countries:

3.   apply the sanctions provided for in Chapter VII of the United Nations Charter against the Zionist entity, in view of its overt intransigence and violations of the principles of the United Nations Charter and the Universal Declaration on Human Rights

IV.   To set up a 5 member committee composed of ministers from Pakistan, Senegal, Malaysia and Guinea and the Secretary General, whose mandate is to make adequate preparations and necessary contacts to follow up and implement paragraph on above. The 5- member Committee may seek the assistance of any person, and take whatever measures it deems necessary to ensure the success of its mission and the achievement of its objectives;

V.   To sever all forms of political, economic, cultural, technical, tourist and communication relations with the Zionist entity;

VI.   To accept the representation of the Palestine Liberation Organization in the remaining capitals of Islamic States in its capacity as the sole and legitimate representative of the Palestinian people, and to grant it all rights, privileges and immunities;

VII.   To express their deep concern at the continued Israeli acts of aggression against the Palestinian people, the Palestine Liberation Organization, Syria and Lebanon and reiterate their commitment to the Palestinian people, PLO, Syria and Lebanon, and their total support to them in the face of any Zionist aggression. To call upon all international bodies and institutions to stand firmly against Israeli escalation and totally reject any interference in the internal affairs of Lebanon;

VIII. To reaffirm the commitment of member states to all resolutions adopted by this conference on the normalization of relations between the Egyptian regime and the Zionist entity and affirm its determination to persist in its resistance to the process of normalization with a view to foiling it, considering that it jeopardizes tho future of the question of Palestine and the destiny of the Palestinian people;

IX.   To consolidate Arab efforts presently exerted to incorporate the budget of the UNRWA in the regular budget of the United Nations;

X.   To request the Secretary-General to ensure full cooperation, and complete coordination between the General Secretariat of the Organization of the Islamic Conference and the Palestine Liberation Organization with a view to implementing the "Islamic Plan cf Action to counter the Zionist enemy" adopted by the Third Islamic Summit and to submit a progress report thereon to Al-Quds Committee and to the next Islamic Conference.

RESOLUTION NO: 2/12-P

AL-QUDS AL-SHARIF

The Twelfth Islamic Conference of Foreign Ministers held in Baghdad, Republic of Iraq, from 28 Rajab-3 Shaaban l401H, (l-5 June, 1981);

Considering the provisions of the Charter and the resolutions of the Organisation of the Islamic Conference,

Considering the resolutions adopted by the Third Islamic Summit Conference held in Makka Al-Mukarrana/Taif (Session of Palestine and Al-Quds Al-Sharif),

Reaffirming its total commitment to the preservation of the Arab character of Al-Quds Al-Sharif, its liberation, and its restoration to Arab sovereignty so that it becomes the capital of the independent Palestinian state under the leadership of the Palestine Liberation Organisation,

Expressing the reverence in which the Islamic world holds the city of Al-Quds Al-Sharif, and the deep=rooted and eternal attachment of the Islamic world to Al-Aqsa Mosque, the first Qibla, the third Haram, and the site of the Isra'a of Prophet Muhammad,

I. Decides to link in fraternal bonds the city of Al-Quds Al-Sharif, capital of Palestine, and all the capitals of Islamic States as a symbol of Muslim solidarity with the Arab Palestinian inhabitants of the city of Al-Quds Al-Sharif, and to pay tribute to their steadfastness, determination and resistance to the heinous Israeli occupation.
II. Totally Rejects all acts of aggression perpetrated by the Israeli enemy against this Holy City, and its rightful inhabitants, considers them null and void and asks that they be opposed by all ways and means.
III. Strongly condemns the deliberate Israeli attempts to change the cultural and basic character of the Holy City, with a view to judaizing and annexing it to become the "so-called eternal capital" of that Zionist/entity, that deliberately ignores and challenges the international will which rejected such measures and expressed its rejection thereof, in several resolutions adopted by the UN General Assembly, the Security Council, UNESCO, the Non-Aligned Movement and other international fora and organisations.
IV. Expresses the commitment of Member States to mobilize all their military, political and economic potentials as well as natural resources, including oil, as an effective means whereby to liberate the city of Al-Quds Al-Sharif, and vindicate the inalienable national rights of the Palestinian people.
V. Affirms that needed and rapid contacts shall be made with the Member States of the UNESCO Heritage Committee with a view to declaring Al-Quds Al-Sharif an historical city whose character may not be impaired.
VI. Requests the Secretary-General to follow-up- the implementation of this resolution, in total cooperation with Palestine/the Palestine Liberation Organisation, and secure these bonds of fraternity within one year, and submit a complete report thereon to Al-Quds Committee and the next Islamic Conference.

RESOLUTION NO. 4/12-P

THE ISRAELI PROJECT TO DIG A CANAL

LINKING THE MEDITERRANEAN TO THE DEAD SEA

The Twelfth Islamic Conference of Foreign Ministers held in Baghdad, Republic of Iraq, from 28 Rajab to 3 Sha'aban 1401H (1-5 June, 1981),

Considering the provisions of the Charter and Resolutions of the Islamic Conference,

Considering the "Makkah Declaration" and the 'Declaration of Holy Jihad adopted by the Third Islamic Summit Conference held in Makkah Al Mukarramah/Taif (Session of Palestine and Al Quds Al Sharif),

Considering the illegitimate nature of continued Israeli occupation of Palestine and the other Arab territories,

Seriously concerned over the Israeli enemy's project to dig a canal in occupied Palestine, extending from South of the city of Gaza in the West, to the Dead Sea in the East, 'and the strategic, demographic,' geographic and economic changes involved in this project which will seriously endanger the Palestinian national economy and other Arab and Jordanian projects, and create new natural and human barriers between the Arab Masfarek and Maghreb,

Considering that this new aggressive Zionist project constitutes a sustained violation of the inalienable national rights of the Palestinian people by the Zionist enemy who persists in perpetrating aggression and plundering the natural resources of the Palestinian people,

Aware of the fact that the implementation of such a project will consolidate the Zionist presence in the heart of the Arab nation and the Islamic World, and that material, human, economic and strategic gains shall ensue there from the Zionist enemy,

DECIDES:

I.    To condemn strongly the new Zionist aggression against the natural resources and national inalienable rights of the Palestine people; and warns the Zionist enemy against the serious consequences of its continued aggression and its implementation of the project to dig a canal linking the Mediterranean with the Dead Sea;
II.    To call upon international organizations and world public opinion to condemn this new Zionist aggression and this continued colonial racist plundering of the natural and national wealth and resources of the Palestinian people;
III.   To call upon states and governments throughout the world to refrain from contributing financial, manpower or technical assistance to the implementation of this project and to abstain from providing material or moral contribution which might help the Israeli enemy to inclement this project;
IV.   To warn institutions, companies and individuals throughout the world, against participation in the implementation of this new aggressive Zionist project, which shall render them liable to the imposition of economic sanctions against them as well as the provisions of Arab and Islamic Boycott regulations'

Requests the Secretary General to follow up the implementation of thin resolution, to inform forthwith Islamic States and their permanent representatives at the United Nations with all new developments in this question, to support any Arab effort exerted at the U.N. and its specialised agencies in this connection; and to submit a report on this question to Al-Quds Committee and to the forthcoming Islamic Conference.

RESOLUTION NO. 5/12-P

ISRAELI VIOLATIONS IN HEBRON (AL KHALIL)

The Twelfth Islamic Conference of Foreign Ministers held in Baghdad, Republic of Iraq, from 28 Rajab to 3 Sha'aban 1401 H(1-5 June 1981),

Noting the perpetuation of Israeli, occupation of the West Bank, and the terrorist practices of this occupation against the Arab inhabitants, such as expropriation of lands and establishment of Israeli settlements, in contravention of International charters and treaties,

Noting the dangerous escalation of Judaisation measures focused presently on Hebron, on the occupied West Bank, which has become the second site in Israeli settlement schemes, after the holy city of Al-Quds,

Noting that this escalation follows wide-ranging expropriation measures of Arab lands around. Hebron, amounting to hundreds of thousands of cultivated DUNAMS owned by the Arab inhabitants,

Noting with grave concern the dangerous dimensions of settling new Jewish families in the heart of the city of Hebron, among its Arab inhabitants and in Arab houses around the ADABUYA building, which were evacuated to establish a Jewish quarter in the heart of the Arab city,

Noting with great concern, the continuous Israeli violations of the holy Ibrahimi Mosque, and the transformation of a great part of it into a synagogue. The Conference:

1. Strongly rejects and condemns all Jewish settlement measures in Hebron, and declares them illegal;
2. Expresses its solidarity with the valiant struggle waged by the people of Hebron, and its City Council, against settlement measures, the expropriation of lands and the eviction of Arab citizens from their homes in the city to replace them by Jewish families
3. Urges all countries of the world to uphold the just struggle waged, by the Arab inhabitants in the city and throughout occupied Palestine
4. Calls upon all Member States to raise this question at the next session of the United Nations General Assembly, so that efforts may be exerted to foil the Judaisation plot implemented by Israel in Hebron.

RESOLUTION NO. 6/12-P

VIOLATIONS OF MOSQUES AND ISLAMIC

HOLY PLACES IN OCCUPIED PALESTINE.

The Twelfth Islamic Conference of Foreign Ministers held in Baghdad, Republic of Iraq iron 28 Rajab to Sha'aban 1401 H. (1-5 June 1981);

Noting the grave desecrations by Israel of mosques and Islamic holy places in occupied Palestine which constitute a blatant aggression against Islam and Muslims,

Considering such practices, as well as the detention campaigns and acts of terrorism committed by Israel against Muslim ulemas both in the West Bank and elsewhere in occupied Palestine, as a Zionist campaign designed to quell the Islamic spirit which resists occupation in these regions,

Noting all the relevant resolutions adopted by the U.N. General Assembly and the Security Council,

1.   Condemns the Israeli measures of turning mosques in occupied Palestine into museums, Islamic cemeteries and waqfs into parks and shopping centres and holds Israel responsible for such measures and for continued desecration of Islamic holy places;

2.   Condemns these arbitrary measures, affirming that they are null and void, and illegal and demands that Israel desist from pursuing such policies, release the detained Muslim ulemas and refrain from submitting than to terrorist practices;

3.   Calls upon all countries and peoples throughout the world, as well as the relevant international organisations to adopt a firm stand against Israel's desecration of mosques and Islamic holy places, to ensure a cessation of such acts and to take the necessary measures to protect Islamic holy places and the Islamic cultural heritage;

4.   Bequests the Security Council to investigate such desecrations and send a fact-finding mission to verify the desecration of mosques and Islamic holy places in the occupied, territories;

5.   Calls upon the information media in Member States, in particular those addressing the Western world, to emphasize Israeli desecrations of Islamic holy places and uncover the dimensions of Israeli policies which affect places of worship.

RESOLUTION NO. 7/12-P

CONTINUED SETTLEMENT MEASURES IN AND JUDAIZATION OF THE OCCUPIED

PALESTINIAN AND ARAB TERRITORIES

The Twelfth Islamic Conference of Foreign Ministers, held in Baghdad Republic of Iraq, from 28 Rajab to 3 Sha'aban 1401 H(1-5 June, 1981),

Considering the provisions of the Charter and resolutions of the Islamic Conference,

Considering the resolutions adopted by the Third Islamic Summit Conference held in Makka-al-Mokarramah/Taif (Session of Palestine and Al Quds Al-Sharif),

Considering that Jewish immigration to Palestine constitutes its basic source of manpower which consolidates the Jewish entity and imposes a settler fait accompli in the Occupied Palestinian and Arab territories,

Strongly condemns the growing and accelerated Zionist settlement in the occupied Palestinian and Arab territories, particularly in the city of Al Quds Al Sharif and the city of Al Khalil (Hebron) the increasing acts of expropriation, by force appropriation and judaization of land and property, and the establishment of settlements thereon to the extent that the area of Palestinian land appropriated by force amounts to over, forty percent of the entire area occupied since 1967,

Strongly condemns the aggressive racist policy pursued by the Israeli enemy, namely persecuting the citizens, threatening them into leaving- their homes, evacuating the Palestinian and Arab territories of their legitimate inhabitants with a view to replacing them by new Zionist immigrants, as part of the enemy's expansionist, colonialist and racist schemes,

Strongly condemns the recent Zionist assaults against.the City of Al Khalil (Hebron) and the enemy's fierce attempts to evict the Palestinian citizens by force from their homes in the heart of that city to replace them by new Zionist immigrants, with a view to Judaizing the whole city, having beforehand established several settlements around and within it, appropriated a large section of Al Haram Al Ibrahimi Al Sharif, and turned it into a synagogue, thus preventing Muslims from performing their prayers normally at regular times.

Reaffirms its commitment to the principle of the "inadmissibility of acquisition of territories by force", and considers that all the settlements already established or which will be established by the Israeli enemy in the occupied Palestinian and other Arab territories, including Al Quds and Al Khalil, are null and void, as well as illegal, that they should be dismantled and new settlement be prevented, in accordance with the U.N. Security Council's resolution 452 of 1979, and 465 of 1980; It holds the Israeli enemy and its supporters wholly responsible for all measures pertaining to changes, exploitation, sabotage, expropriation or appropriation of land, by force within the occupied Palestinian and Arab territories;

Calls upon the international community, and all international organisations, institutions and agencies to uphold Islamic States in their condemnation of the Israeli enemy for its continued official and organized terrorism, and for its racist, expansionist and colonialist policies in the occupied Palestinian and Arab territories, particularly in the cities of Al Quds Al-Sharif and Al-Khalil, and requests them to impose sanctions against Israel;

Requests member states to make the necessary contacts with States which allow Jewish emigration to Israel and grant transit facilities across their territories to this effect to abstain from doing so, in view of the illegal Zionist enemy in its denial of the right of the Palestinian people "to return to their homeland, their right to self determination, to exercise their sovereignty and to establish their own independent state on their national soil.

It also calls upon the member states to encourage Jewish emigration from occupied Palestine to other countries.

Requests the Secretary General to follow on this serious issue, in cooperation and coordination with the Islamic group at the United Nations, and to submit a report thereon to Al-Quds Committee and to the next Islamic Conference.

RESOLUTION NO. 10/11-P

ISRAELI ACTS OF AGGRESSION AGAINST

THE PALESTINIAN CAMPS IN LEBANON

The Twelfth Islamic Conference of Foreign Ministers held in Baghdad, Republic of Iraq, from 28 Rajab to 3 Sha'aban 1401 H 1-5 June, 198O,

Considering the provisions of the Charter and the resolutions of the Islamic Conference,

Considering the resolutions adopted by the Third Islamic Summit Conference, held at Makka-al-Makkarasmah/Taif (Session of Palestine and Al-Quds Al Sharif),

Expressing deep concern over the current violent events, ensuing from the escalating Israeli acts of aggression against Palestinian Camps in Lebanon, that would have been impossible without American support, and which threatened, to explode the critical situation, thus resulting in the outbreak of a full-scale war in the Middle East and considers the Zionist military escalation as part of a plot jointly hatched by the USA and Zionism to impose hegemony end surrender on the entire Arab region, as well as an integral part of the traitorous Camp David plot,

Strongly condemns the official and organized terrorism perpetrated by the Israeli enemy as evidenced by its repeated brutal raids, the genocide of Palestinian refugee camps and the PLO, with a view to liquidating the Palestinian resistance movement and, consequently, the Palestinian question;

Strongly condemns the U.S. practices because of its continued support of the Israeli enemy, its providing it with the most sophisticated weapons for destruction even those that are INTERNATIONALLY banned, which the Israeli enemy uses against innocent people;

Reaffirms its determination to safeguard the independence, territorial integrity and national unity of Lebanon;

Expresses its support for Arab efforts exerted to bring about a national reconciliation among the Lebanese people, and to facilitate the return of evacuees and migrants to their cities and villages;

Commends the heroic steadfastness in the face of repeated Israeli attacks, and the declared genocide perpetrated by the Zionist enemy, through daily acts of aggression against Lebanese cities and villages and the Palestinian refugee camps, and considers that such acts of aggression are waged against the Arab nation and the Islamic Ummah;

Requests the Secretary General to follow up the development of events in Lebanon,  coordinate the stand of member countries with the League of Arab States, and inform Islamic countries and as well as the Islamic Group at the UN, of current and future developments so that they could act accordingly;

Requests the Secretary-General to follow up the implementation of this resolution, end submit a report thereon to the next Islamic Conference.

RESOLUTION NO. 13/12-P

A PALESTINE STAMP

The Twelfth Islamic Conference of Foreign Ministers held in Baghdad, Republic of Iraq, from 28 Rajab – 3 Sha'aban 1401 H (1-5 June, 1981),

Considering the provisions of the Charter and resolutions of the Islamic Conference,

Commending the Islamic Countries which issued a Palestine stamp following the decision, taken by the Sixth Islamic Conference, held in Istanbul, and those countries which transferred the proceeds from its sale to the Palestine Welfare Society, in particular the sister Republic of Iraq,

Aware of the importance of issuing a Palestine stamp according to specifications, in every Islamic country, on a regular and sustained basis, as long as the Palestine question is not solved as agreed upon because it will serve the interests of the question of Palestine and Al Quds Al Sharif at information level, and materially assist the families of the Palestinian martyrs and mujahideen,

Considering the resolutions adopted by the Third Islamic Summit Conference held in Makkah Al Mukarramah/Taif (Session of Palestine and Al Quds Al Sharif),

Decides:

1. To request Member States that have not yet done so, to issue a Palestine stamp, according to specifications, on a regular and sustained basis, as long as the Palestine question is not solved as agreed upon;
2. To request the Secretary General to follow-up the implementation of this resolution and submit a progress report thereon to Al-Quds Committee and the next Islamic Conference.

RESOLUTION N0.14/l2-P

THE ISLAMIC OFFICES FOR MILITARY COORDINATION

WITH PALESTINE

The Twelfth Islamic Conference of Foreign Ministers held in Baghdad, Republic of Iraq, from 28 Rajab -3 Sha'aban 1401 H, (1-5 June, 1981),

Considering the provision of the Charter and the resolutions of the Islamic Conference,

Considering the resolutions adopted by the Third Islamic Summit Conference, held in Makka-al-Mokarramah/Taif (Session of Palestine and Al-Quds Al-Sharif) on the "Islamic Programme of Action to counter the Zionist Enemy", the Declaration of Holy Jihad; and the Makka Declaration,

Decides:

1.   To establish an Islamic Office for Military Coordination with Palestine at the General Secretariat, within the coming six months so that it may carry out the functions assigned thereto and ensure military coordination with the Palestine Liberation Organization and Islamic countries in such a manner as would secure optimal utilization of their potentials, promote the Palestinian struggle, and meet the needs of the Palestine Liberation Organization in terms of skills and military requirements both quantitatively end qualitatively;

2. (a)That the Secretary General of the Organization of the Islamic Conference appoint, after prior consultations with the Palestine Liberation Organisation, a Muslim Officer with the rank of General to head the Islamic Office for Military Coordination with Palestine, assisted by an adequate number of officers and staff of various ranks;

(b)That the Director of the Islamic Office for Military Coordination with Palestine be entitled to the post, grade, salary and benefits of an Assistant Secretary General while the other officers and military staff of the office be entitled to posts, grades, salaries and benefits 'similar to those of their counterparts in the main departments of the General Secretariat of the Islamic Conference;

(c)That the Islamic Office for Military Coordination with Palestine be considered as a main specialised department of the General Secretariat, whose Director shall report directly to the Secretary General. The Department shall be staff governed by all the rules and regulations in force at the Organization of the Islamic Conference;

3.  To request the Secretary General to follow up the implementation of this resolution and submit a progress report thereon to Al Quds Committee and the next Islamic Conference.

RESOLUTION N0.15/12-P

THE ISLAMIC OFFICE FOR THE BOYCOTT OF ISRAEL

The Twelfth Islamic Conference of Foreign Ministers held in Baghdad, Republic of Iraq, from 28 Rajah to 3 Sha'aban 1401 H, (1-5 June, 1981),

Considering the provisions of the Charter and the resolutions adopted by the Islamic Conference,

Contending the resolutions adopted by the League of Arab States on the boycott of Israel, and the recommendations of conferences of the Liaison Officers of the Arab regional offices for the boycott of Israel, and the vital role played by the Head Office for the Arab Boycott of Israel in Damascus,

Considering the resolutions adopted by the Third Islamic Summit Conference, Makka-al-Mokkarramah/Taif (Session of Palestine and Al-Quds Al-Sharif) on the "Islamic programme of action to counter the Zionist enemy", the declaration of Holy Jihad and the Makka Declaration,

Decides:

1.  To finalise the establishment of the Islamic Office for the Boycott of Israel at the General Secretariat and to appoint a High Commissioner thereof within the coming six months, so that it nay undertake its activities in accordance with the same principles, bases, provisions, duties, competences, procedures and privileges be undertaken by the Main Office for the Arab Boycott of Israel in Damascus, affiliated to the League of Arab states;

2.  To endorse all the recommendations made in the joint report on the negotiations held between the OIC delegation and the relevant officials at the Head Office for the Arab Boycott of Israel in Damascus from 19 to 21/5/1981, in addition to the explanatory note, annexed to this report, on the measures to be adopted including the organisation chart proposed for the administrative and technical functioning of the Islamic Office;

3.  To secure close cooperation and coordination between the Arab and Islamic Offices with a view to ensuring maximum effective application of the provisions of tho boycott of Israel in Islamic countries;

4. (a)That the Commissioner of the Islamic office for the Boycott of Israel be entitled to the same post, grade, salary and benefits as an Assistant Secretary General, while the office staff members of the office be entitled to posts, grades, salaries and benefit similar to those Of their counterparts applied in the main department of the General Secretariat of the organisation of the Islamic Conference;

(b)That the Islamic Office for the Boycott of Israel shall be considered as a main specialised department of the General Secretariat which, through its Commissioner, shall be directly attached to the Secretary General, and whose staff members are governed by the rules and regulations as well as directives enforced at the Organisation of the Islamic Conference;

5.  To request the Secretary-General to follow up the implementation of this resolution, end to submit a progress report thereon to Al-Quds Committee and the next Islamic Conference.

RESOLUTION NO. 18/12-P

ISLAMIC SOLIDARITY DAY WITH THE PALESTINE PEOPLE

(21 AUGUST EVERY YEAR)

The Twelfth Islamic Conference of Foreign Ministers, meeting in Baghdad, Republic of Iraq, from 28 Rajab – 3 Sha'aban l401 H, (1-5 June 1981),

Considering the provisions of the Charter and the resolutions of the Islamic Conference,

Considering the resolutions adopted by the Third Islamic Summit Conference held in Makka al-Mukarrama/Taif (Session of Palestine and Al-Quds Al Sharif),

Reaffirms its commitment to the implementation of all previous Islamic Resolutions, the most recent being resolution 13/11-PIL adopted by the Eleventh Islamic Conference held in Islamabad on Celebrating an Islamic Solidarity Day with the people of Palestine, on 21 August, every year;

Requests the Secretary General to ensure that this resolution is implemented in all the Islamic countries at the same time in total cooperation with the Palestine Liberation Organisation and full coordination with the Islamic States Broadcasting Organization (ISBO) at the International Islamic News Agency (IINA), and to submit a progress report thereon to Al-Quds Committee and the next Islamic Conference.

3. Third United Nations Seminar on the Inalienable Rights

of the Palestinian People held in Colombo,

Sri Lanka from 10 to 14 August 1981

1. In accordance with the terms of General Assembly resolution 34/65D the Third United Nations Seminar on the Question of Palestine, with its central theme "the Inalienable Rights of the Palestinian people", took place at the Bandaranaike Memorial International Conference Hall, Colombo, Sri Lanka, from 10-14 August 1981. Seven meetings were held at which eleven panelists presented papers on various aspects of the Question of Palestine.

2. The United Nations Committee on the Exercise of the Inalienable Rights of the Palestinian People was represented by a delegation consisting of His Excellency Mr. Massamba Sarré (Senegal); Chairman, Mr. Gerhard Schreter (German Democratic Republic): Mr. Vijay Nambiar (India); Mr. Henri Rasolondraibe (Madagascar); Qazi Shaukat Fareed (Pakistan) and Mr. Zehdi L. Terzi ( Palestine Liberation Organization). Mr. V. Nambiar acted as Rapporteur of the Seminar.

3. The opening session of the Seminar on 10 August 1981 was addressed by the Honourable Tyronne Fernando, Acting Minister of Foreign Affairs of the Democratic Socialist Republic of Sri Lanka who, in welcoming the participants noted the useful role played by these seminars in acquainting the public with the facts surrounding the Question of Palestine, and suggested that the Committee on the Exercise of the Inalienable Rights of the Palestinian People should examine how the papers presented at the Seminar could be given the widest possible dissemination through the information system of the United Nations.  He also drew attention to the Government of Sri Lanka's recognition of the inalienable rights of the Palestinian people and its full support to the Palestinian cause at all international forums where Sri Lanka had, along with other States, worked hard for the participation of the Palestine Liberation Organization in the processes for the settlement of the question of 36

At the same session, H.E. Mr. Massamba Sarré, Chairman of the Committee, gave a brief account of the Committee and its work and stressed the importance which was placed on publicity for the Question of Palestine and on the necessity to ensure that all facts surrounding the issue reached the public. His Excellency Mr. Faisal Aweida, the Special Representative of Mr. Yasser Arafat, Chairman of the Executive Committee of the Palestine Liberation Organization thanked the Committee on the Exercise of the Inalienable Rights of the Palestinian People for the interest it has been taking in promoting the just cause of the Palestinian people and asked the Committee to impress upon the international community the need to find ways and means of implementing United Nations resolutions on the question of Palestine. At the sixth meeting, Mr. Aweida conveyed to the Seminar a message from Chairman Yasser Arafat on behalf of the Executive Committee of the Palestine Liberation Organization. The text of the message is annexed to the report. At the closing session the Honourable M. H. Mohamed, Minister of Transport made a statement on behalf of the Government of the Democratic Socialist Republic of Sri Lanka.

4. Five panels were established to consider different aspects of the central theme "The inalienable rights of the Palestinian people". These panels, the panelists and titles of the papers presented were as follows:

A. Panel 1. Fundamental Rights of the Palestinian People

Dr. M. G. Agwani (India): Dr. Stanislaw Matosek (Poland): Dr. Fouad Moughrabi (United States) presented the following papers entitled "The Fundamental Rights of the Palestinian People", "Certain Aspects of the Inalienable Rights of the Palestinian People" and "The Palestinian Right to Self Determination" respectively.

B. Panel 2. Legal Issues in the Palestine Question

Dr. Türkkaya Ataöv (Turkey) and Dr. Mohammed Akbar Kherad (Afghanistan) presented papers entitled "The Use of Palestinian Waters and International Law", and "The National Identity and the Inalienable Rights of the Palestinian People" respectively.

C. Panel 3. Human Rights and Palestine

Mrs. Salwa Abu Khadra (Palestinian); Dr. Hassan Haddad (United States); and Dr. Sardar Mohammad (Pakistan) presented papers: "The Palestinian Question, and the Human Rights of the Palestinian Child"; "Fundamental Rights of the Palestinians: the Primal Crime and the Ambiguities of Chosenness" and "Restoration of Human Rights of the Palestinian People: the Role of the United Nations and the Super-powers" respectively.

D. Panel 4. The Palestine Issue and Asian Public Opinion

Dr. Abdel-Malik Ali Ahmed Auda (Egypt and Mr. Mervyn de Silva (Sri Lanka) presented, papers entitled "The Question of Palestine and Asian Public Opinion and "Old Images, New Perceptions – Opinion Trends in Sri Lanka" respectively

E. Panel 5. The Nature of the Palestine Liberation Organization

Mr. Afif Safiyeh (Palestinian) presented a paper entitled "The PLO: the Challenge and the Response".

An introductory statement on Israeli settlement policies in the Occupied Arab Territories was also presented by Professor Fouad Moushrabi (United States) as a basis for discussion.

5. The exchange of views with which each meeting was concluded indicated that there was general agreement amongst the participants over a wide range of issues relating to the restoration of the inalienable rights of the Palestinian people.

The discussions covered all aspects of the rights of the Palestinian and the manner in which they were systematically and continuously violated by Israel. It was agreed that the Question of Palestine was at the core of the Middle East problem and was the result of an accumulation of illegalities.

This was a concern not merely of the Palestinian people but of all the Arab people-as well as the people of all countries of the world in terms of the moral, political and human issues arising therefrom.

6. In view of the depth of analysis contained in the papers presented at the Seminar, and in accordance with established practice, they will he published by the United Nations along with the report of the Seminar as a contribution to a wider understanding of the question of Palestine.

4.   Fourth United Nations Seminar on the Inalienable Rights

of the Palestinian People held in

Havana, Cuba from 31 August to 4_ September 1981

1.  In accordance with the terms of General Assembly resolution 34/65D, the Fourth United Nation's Seminar on the Question of Palestine, with its central theme "The inalienable Rights of the Palestinian People" took place at the Palacio de las Convenciones, Havana, Cuba, from 31 August to 4 September 1981. Eight meetings were held at which fifteen panelists presented papers on various aspects of the Question of Palestine.

2.  The United nations Committee on the Exercise of the Inalienable Rights of the Palestinian People was represented by a delegation consisting of His Excellency, Mr. Massamba Sarré, (General), Chairman: Mr. Farid Zarif (Afghanistan), Vice Chairman: His Excellency, Mr. Andreas V. Mavrommatis (Cyprus) and Mr. Zehdi L. Terzi (Palestine Liberation Organization), Mr. Mavrommatis acted as Rapporteur of the Seminar.

3.  The opening session was attended by His Excellency, Mr.Jesus Montané Oropesa, alternate member of the Political Bureau and Chief of the Department of International Affairs of the Communist Party of Cuba Who represented the Head of State, President Fidel Castro Rus.

4.  The opening session of the Seminar on 31 August 1981 was addressed by His Excellency Mr. Jose Raúl Viera Linares, Acting Minister for Foreign Affair of Cuba, who on behalf of his Government, welcomed the holding of the Seminar in Cuba since it was devoted to one of the most noble causer, of contemporary history because of the long suffering of the Palestinian people. He added that the promotion of this type of Seminar reaffirmed the priority to accorded by the United Nations General Assembly and the movement of Non-Aligned Countries to the realization of the inalienable rights of the Palestinian people.  He stressed also the importance of increasing the solidarity of the international community with Palestine and of bringing to international public opinion full knowledge of the facts of the tragedy of the Palestinian people.

5.  At the same session His Excellency, Mr. Massamba Sarré, Chairman of the Committee, gave a brief account of the Committee and its work and stressed the importance of ensuring that all facts surrounding the Question of Palestine reached the public so that a proper understanding of the issues would be achieved. A message from Mr. Yasser Arafat, Chairman of the Executive Committee of the Palestine Liberation Organization, was conveyed to the Seminar by Mr. Abdullah Abdullah, his special representative to the Seminar.

6.  At the opening session of the Seminar, a minute of silence was observed in memory of two distinguished Latin American leaders recently killed in air accidents the President of Ecuador, Jaime Roldos Aguilera, the Commander of the National Guard and former Head of State of Panama, General Omar Torrijos. The Seminar commenced its next session with the observance of one minute of silence in memory of the late Mohammad Ali Rajai and Mohammad Javad Bohanar, President and Prime Minister of Iran, respectively, news of whose tragic deaths had been received officially that afternoon.

7.  The closing session was addressed by His Excellency, Mr. Vecino Alegret, Minister of Higher Education of Cuba.

8.  Six panels were established to consider different aspects of the central theme "the inalienable rights of the Palestinian people". These panels, the panelists and titles of the papers presented were as follows:

A.  Panel 1: Israeli Settlement Policies in the Occupied Arab Territories

Dr. Janet Abu-Lughod (United States) and Mr. Raja Shihadeh (Palestinian) presented papers entitled. "Israeli Settlements in Occupied Arab land Conquest to Colony" and "Analysis of the Legal Structure of Israeli settlements in the Occupied West Bank of Jordan" respectively.

B.  Panel 2: Human Rights and Palestine

Dr. Muhammad Hallaj (Palestinian), Dr. Julio Prado Vallejo (Ecuador) and Dr. John Quigley (United States) presented papers entitled "Political Aborticide: Israel's Palestinian Policy", "Human Rights and Palestine" and "Human Rights and Palestine: Recent Developments" respectively.

C.  Panel 3_: The Nature of the Palestine Liberation Organization

Dr. Bayan Nuwaihed al Hout (Palestinian) presented a paper entitled "The Nature of the Palestine Liberation Organization:  The Identity".

D.  Panel 4: Legal Issues in the Palestine Question

Dr. Ibrahim Abu-Lughod (Palestinian) and Dr. Horacio Sevilla Borja (Ecuador) presented papers entitled "Retrieving Palestinian National Rights and "Some Considerations on the Establishment of a Palestinian State" respectively.

E.  Panel 5: The Palestine Issue and Latin American Public Opinion

Dr. Juan Abughattas Abughattas (Peru), Dr. Domingo Alberto Rangel (Venezuela), Dr. Camilo Octavio Perez (Panama) and Dr. Miguel D'Estafano Pisani (Cuba) presented papers entitled "The Perception of the Palestinian Question in Latin America", "Zionist Control of the Communications Media and of the Cultural System in Venezuela and The Struggle of the Palestinian People", "The Palestine Issue and Latin American Public Opinion" and "The Fundamental Rights of the Palestinian People" respectively.

F.  Panel 6 : Fundamental Rights of the Palestinian People

Dr. Humberto Diaz-Casanueva (Chile), Mr. David Gilmour (United Kingdom) and Lic. Jose Antonio Garcia Lara (Cuba) presented papers entitled "Implications of the Process of Implementing the Fundamental Rights of the Palestinian People", "The Fundamental Rights of the Palestinian People" and "The Rights of the Palestinian People" respectively.

9.  It was clear from the exchange of views that there was consensus the participants on the main points raised by the panelists an well as over a wide range of issues relating to the restoration of the inalienable rights of the Palestinian people. The discussions covered all aspects of the rights of the Palestinian people and the manner in which they were consistently violated by Israel.  It was agreed that the situation in Palestine was not merely the concern of the Palestinian people and the Arab nation hut involved the entire international community, insofar as it constitutes, a threat to international peace and security, and is a violation of internationally accepted principles.

10.  In view of the depth of analysis contained in the papers presented at the Seminar, and in accordance with established practice, they will be published by the United Nations along with the report of the Seminar as a contribution to a wider understanding of the Palestine Question.

5. Resolutions adopted by the Sub-Commission on Prevention of Discrimination

and Protection of Minorities at its thirty-fourth

session held in Geneva from 17 August to 11 September 1981

QUESTION OF THE VIOLATION OF HUMAN RIGHTS AND FUNDAMENTAL FREEDOMS,

INCLUDING POLICIES OF RACIAL DISCRIMINATION AND SEGREGATION AND OF

APARTHEID, IN ALL COUNTRIES, WITH PARTICULAR REFERENCE TO COLONIAL

AND OTHER DEPENDENT COUNTRIES AND TERRITORIES: REPORT OF THE

SUB-COMMISSION UNDER COMMISSION ON HUMAN RIGHTS RESOLUTION 8 (XXIII)*

The Sub-Commission on Prevention of Discrimination and Protection of Minorities,

Guided by the principles and purposes of the Charter of the United Nations, and the Universal Declaration of Human Rights and the principles and provisions of the Geneva Conventions, particularly the fourth Convention,

Guided also by resolutions ES-7/2 and ES-7/3 on the question of "Palestine adopts by the General Assembly on 1 August 1930 at its seventh emergency special session and General Assembly resolutions 35/75 of 5 December 1930 and 35/122 of 11 December 1980,

Recalling its resolution 20 (XXXIII) of 11 September 1980,

Recalling Commission of Human Rights resolutions 1 (XXXVII) and 2 (XXXVII) of 11 February 1981,

Deploring the refusal of the Israeli authorities to abide by the relevant resolution of the General Assembly and the resolutions of the Security Council, mainly resolutions 446 (1979), 465 (1580), 476 (1980), 478 (1980) and 484 (1980),

Gravely concerned by reports of continuing inhuman Israeli practices in the occupied Arab territories,

1.    Expresses its thanks to the Secretary-General of the United Nations for having supplied the Sub-Commission with valuable reports, studies, document, including document E/CN.4/Sub.2/483, statistics and the texts of relevant decisions and resolutions concerning the Palestinian question and describing the multiple violations of human rights committed by Israeli authorities against the Arab population in the occupied territories, and requests the Secretary-General to draw upon all the new documents and studies and to submit a detailed up-to-date and revised report to the Sub-Commission at its thirty-fifth session;

2.   Recommends the Commission on Human Rights to:

(a)  Reaffirm the inalienable right of the Palestinian people to self-determination without external interference and the establishment of a fully independent and sovereign State in Palestine;

(b)  Reaffirm the inalienable right of the Palestinians to return to their home and property, from which they have been displaced and uprooted, and call for their return in the exercise of their right to self-determination;

(c)  Reaffirm the principle of the inadmissibility of the acquisition of territory by force and urge the Israeli authorities to withdraw from all the occupied Arab territories, including the Holy City of Jerusalem, and to stop immediately all excavation and works aimed at the destruction of the essential physical character, demographic composition, historical structure, institutional structure and status of the Holy City of Jerusalem;

(d)  Deplore the violations of human rights committed by Israeli authorities in the occupied Arab territories, including the Holy City of Jerusalem;

(e)  Condemn bombardment of Palestinian refugee camps in the south of Lebanon as well as in the heart of the city cf Beirut which resulted in the  loss of the lives of hundreds of civilians, both Palestinians and Lebanese, in complete disregard of all norms cf International law, of human rights and the Geneva Conventions;

(f)  Disapprove of and regret the refusal of Israel to implement the relevant resolutions and decisions of the General Assembly and the Security Council concerning the Holy City of Jerusalem;

3.   Recommends the Commission on Human Rights and the Economic and Social Council to take, as a matter of urgency,  the necessary measures for the implementation of this resolution.

QUESTION OF THE HUMAN RIGHTS OF PERSONS SUBJECTED

TO ANY FORM OF DETENTION OR IMPRISONMENT*

The Sub-Commission on Prevention of Discrimination and Protection of Minorities.

Mindful of the principles of the Charter of the United Nations, the Universal in ration of Human Rights, and international instruments for the protection of human and fundamental freedoms,

Recalling the Declaration on the Protection of All Persons from Being Subjected to Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment adopted by the General Assembly on 9 December 1975,

Recalling its resolution 15 (XXXIII) of 11 September 1980,

Recognizing that the Geneva Convention relative to the Protection of Civilian Persons in Time of War is applicable to all the Arab territories occupied by Israel,

Taking into consideration the report of the United Nations Special Committee to Investigate Israeli Practices Affecting the Human Rights of the Population of the Occupied Territories,

Requests the Commission on Human Rights to:

(a) Condemn Israeli violations of the Charter of the United Nations and the Universal Declaration of Human Rights, in particular the mass arrests, collective punishment, administrative detention and ill-treatment of the Arab population, the torture of persons under detention and the inhuman conditions in Israeli prisoner

(b) Call on Israel to release all Palestinian political detainees or prisoners and to ameliorate the conditions of all detainees and prisoners held in Israeli prisons, with a view to meeting international standards.

6.  Communique of the Meeting of the Ministers of

Foreign Affairs and Heads of Delegations

of the Non-Aligned Countries to the thirty-sixth

session of the General Assembly

At the meetings held on 25 and 28 September 1981 the Ministers of Foreign Affairs and Heads of Delegations to the thirty-sixth session of the United Nations General Assembly issued a communique that states the following in connexion with the Middle East question:

The Meeting called upon all States to assist and facilitate actions and movements by the Palestinian people, under the leadership of the Palestine Liberation Organization, to pursue its efforts and legitimate struggle to achieve its inalienable rights, including the right of return, right of self-determination and right to establish its own independent sovereign State in Palestine, in the context of a comprehensive and just settlement that would ensure peace and stability in the region.

The Meeting condemned-all initiatives to impose those previsions of the Camp David Accords purporting to determine the future of the Palestinian people and Palestinian territories occupied by Israel in spite of the fact that the United Nations General Assembly resolution declared that those provisions had no validity.  They also condemned any partial or separate solution and any agreement that would harm the rights of the Arab countries and the Palestinian people; violate the principles and resolutions of the Movement of Non-Aligned Countries an the United Nations General Assembly or prevent the liberation of Jerusalem and the occupied Palestinian and Arab territories and the attainment and full exercise by the Palestinian people of their inalienable nation rights

The Ministers and Heads of Delegation condemned Israeli policies of aggression and expansionism intensified recently against the Palestinian people, in particular in the territories occupied since 1967, the expropriation of land, the establishment of settlements and the usurpation of water and other natural resources which are considered essential.for the livelihood of the Palestinian people.

They recalled Security Council Resolutions 465 (1980) and 478 (1980) and condemned the promulgation of the "fundamental law on Jerusalem" as well as all other measures tending to alter the demo-graphic composition, the geographic character and the institutional structure of the occupied Arab territories.

The Ministers and Heads of Delegation strongly condemned Israeli measures aiming at the Judaization of the Holy City of Jerusalem including the ongoing excavations under and around the Moslem holy places of worship.

Furthermore, they expressed their most profound concern over the continuing deep diggings and excavations beneath the Al-Aqsa Mosque and the Dome of the Rock within the Haram al-shareef holy sanctuary in Jerusalem which threaten the collapse of these millenia-old structures.  They endorsed the UNESCO resolution of 11 September 1981 to place East Jerusalem on UNESCO's World Heritage Committee list, in order to safeguard the cultural and historical sites in the City.

The Ministers and Heads of Delegation denounced the project for the digging of a canal joining the Mediterranean and Dead Seas and declared that its opening would constitute an act of aggression that would threaten international peace and security.  They called on all countries not to provide Israel with human or moral support, or political and economic assistance, including the necessary equipment for the construction of this canal.

The Meeting condemned Israeli policies and practices aimed at imposing the Israeli nationality on Syrian citizens under Israeli occupation in the Golan Heights.

The Ministers and Heads of Delegation recalled Resolution ES-7/2, adopted by the General Assembly-at its Emergency Special Session (July 1980) and noted with grave concern that since that date the recommendations of the General Assembly and of the Committee on the Exercise of the Inalienable Rights of the Palestinian People have not yet been implemented.  They invited the Security Council to consider the situation and adopt measures without further delay with a view to enabling the Palestinian people to exercise their inalienable rights.  They condemned the hostile position of the Government of the United-States of America towards the inalineable national rights of the Palestinian people and its sole legitimate representative, the Palestine Liberation Organization.

The Ministers and Heads of Delegation decided that an extraordinary meeting of the Coordinating Bureau at the Ministerial level should be held at the appropriate time to undertake an evaluation of the situation and take practical measures to strengthen comprehensive assistance to the struggle of the Palestinian people and to attain and. freely exercise its inalienable rights under the leadership of the Palestine Liberation Organization.

The Ministers and Heads of Delegation expressed grave concern at the continued escalation of the barbaric attacks by Israel on southern Lebanon and Palestinian refugee camps in Lebanon. They recalled that the Sixth 'Summit Conference considered that aggression, carried out by land, sea and air, as tantamount to genocide of the Lebanese people and the Palestinian refugees, with Israel using the most sophisticated weapons supplied by the United States of America.

The Ministers and Heads of Delegation noted with concern that the Government of the United States is currently engaged in the conclusion of a "strategic alliance" in the Middle East instead of participating in the endeavors to achieve a comprehensive and just solution based on Israel's total and unconditional withdrawal from all the occupied Palestinian and Arab territories and the restoration of the inalienable rights of the Palestinian people. They declared their grave concern over the development of the "strategic cooperation" between the Governments of the United States of America and Israel, which confirms the role of the latter as a true bridgehead of imperialism, as an element threatening the stability of the countries in the Middle East region as well as international peace and security.

The Ministers and Heads of Delegations strongly condemned the naked Israeli aggression on the Iraqi nuclear installations devoted exclusively to peaceful purposes as an act of state terrorism and a blatant violation of the sovereignty of a non-aligned country. The Meeting reaffirmed the inalienable right of non-aligned countries to develop nuclear energy for peaceful purposes in conformity with their priorities, interests and needs.  The Ministers and Heads of Delegation reaffirmed the General Assembly resolutions concerning Israeli nuclear armaments, the Security Council Resolution 487 of 18 June 1981, and demanded that Israel comply with said Resolutions. In particular, the Meeting called upon the Security Council to take effective measures against Israel in accordance with Chapter VII of the United Nations Charter, and they pledged themselves to work at the 36th Session of the General Assembly to adopt decisions that will prevent Israel from committing further acts of aggression and force it to comply with the norms of international law, the principles of the Charter and the provisions of the relevant resolutions of the United Nations.

The Non-Aligned Countries called upon all States, and especially the United States of America, to refrain from giving Israel any human, military, political or economic assistance that might encourage it to pursue its aggressive policies against the Arab countries and the Palestinian people.

The Ministers and Heads of Delegation reiterated their support for Lebanon's sovereignty, territorial integrity, unity and political independence, and called for the full implementation of Security Council Resolution 425 (1981).  They condemned continued Israeli aggression and acts of violence against Lebanon and interference in Lebanon's national affairs.  They condemned, in particular, the recent Israeli raids on South Lebanon and Beirut, which caused heavy casualties among the Lebanese civilian population and extensive damage to property.  In that context, they recalled Security Council Resolution 490 (1981), which reads as follows:

"The Security Council,

Reaffirming the urgent appeal made by the President and the members of the Security Council on 17 July 1981 (S/14599) which reads as follows:

'The President of the Security Council and the members of the Council, after hearing the report of the Secretary-General, express their deep concern at the extent' of the loss of life and the scale of the destruction caused by the deplorable events that have been taking place for several days in Lebanon.
'They launch an urgent appeal for an immediate end to all armed attacks and for the greatest restraint so that peace and quiet may be established in Lebanon and a just and lasting peace in the Middle East as a whole.'

Taking note of the report of the Secretary-General in this respect,

1.    Calls for an immediate cessation of all armed attacks;

2.   Reaffirms its commitment to the sovereignty, territorial integrity and independence of Lebanon, within its internationally recognized boundaries;

3.   Requests the Secretary-General to report back to the Council on the implementation of this resolution as soon as possible and not later than 48 hours from its adoption."

and supported its contents.  They called further for the restoration of Lebanese Government authority over all its-territory within its internationally recognized borders.  They welcomed the decisions of the Arab Summit Conferences to solve the Lebanese crisis.

The Ministers and Heads of Delegation endorsed the Report of the Mission of the Coordinating Bureau of Non-Aligned Countries that visited Lebanon in August 1981 at the request of Yasser Arafat, Chairman of the Executive Committee of the Palestine Liberation Organization.

7.   Decision adopted by the Executive Board of

UNESCO concerning the preservation of cultural

property in the City of Jerusalem

The Executive Board of UNESCO at its 113th session, that took place from 15 September to 7 October 1981, adopted the following decision:*

The Executive Board,

1.  Recalling all the resolutions adopted by the General Conference of UNESCO and its Executive Board concerning the preservation of cultural property in the City of Jerusalem, particularly 21 C/Resolution 4/l4 adopted by the General Conference at its twenty-first session,

2.  Recalling that the General Conference, in 21 C/Resolution 4/l4, invited Member States "to withhold all recognition of the modifications made by Israel to the character and status of Jerusalem and to abstain from any act that might imply any recognition whatsoever of those modifications" and that it also invited the Director-General "to keep a constant watch on the execution of the resolutions and decisions of the General Conference and Executive Board concerning Jerusalem",

3.  Having taken note of the report of the Director-General (113 EX/12 and Add. 1, 2, 3 and 4) in which is the report of his personal representative in the occupied City of Jerusalem describing the outcome of the mission carried out between 3 and 8 August 1981 and after having listened to the additional information provided orally by the personal representative of the Director-General;

4.  Noting, after considering the facts set out, that it transpires:

(a) that the Israeli occupying authorities are continuing with the excavations, and transformations, the halting of which had been requested by the General Conference;
(b) that the excavations and transformations in progress seriously threaten the historical and cultural sites of Jerusalem and that they have never been brought to such a pitch as they have today as regards both intensity and gravity;

5.   Having taken note of the decision of the World Heritage Committee, taken at its extraordinary session held in Paris on 10 and 11 September 1981 concerning the inclusion of the old city of Jerusalem and its walls on the World Heritage List;

6.   Considering that the General Conference, at its twenty-first session, gave it on explicit mandate to take any measures that it considered appropriate, in conformity with the prerogatives conferred upon it by the Constitution,

7.   Thanks the Director-general for what he has done and the representations he has made to secure implementation of the resolutions concerning the protection of cultural property located in Jerusalem;

8.   Notes with satisfaction the World Heritage Committee's decision to include the old city of Jerusalem and its walls on the World Heritage List;

9.  Recommends that the World Heritage Committee speed up the procedure for including the old city of Jerusalem and its walls on the List of World Heritage in Danger;

10.  Expresses its deep concern at the grave threat posed to the old city of Jerusalem and its walls by Israel's continued excavations and transformations;

11.  Condemns Israel's persistent and deliberate violations of the resolutions adopted by UNESCO in this connection;

12.  Invites the Director-General to undertake a study of the situation of all the cultural property located in Jerusalem and of the dangers to which it is exposed so that the Executive Board can identify the facts making it possible to take the decision that the situation warrants;

13.   Decides to include this item on the agenda of its ll4th session.

8.  Resolution adopted at the 68th Conference of

the Inter-Parliamentary Union held in

Havana, Cuba, from 15 to 23 September 1981

In connexion with violations by Israel of the resolution of the United Nations and the Inter-Parliamentary Union through its behaviour in the occupied Arab territories and its attack against Lebanon, the following resolution was adopted:*

The 68th Inter-Parliamentary Conference,

Recalling the previous resolutions of the Inter-Parliamentary Union on the question of Palestine, the Middle East crisis and the Israeli aggressions against Lebanon, and the resolutions of the 64th Inter-Parliamentary Conference in Sofia (1977), 65th Inter-Parliamentary Conference in Bonn (1978), 66th Inter-Parliamentary Conference in Caracas (1979) and 67th Inter-Parliamentary Conference in Berlin-GDR (1980), and of the Inter-Parliamentary Council adopted in Lisbon in 1978,

Recalling also all the resolutions of the United Nations Security Council and General Assembly on the Middle East problem, on the exercise of the inalienable rights of the Palestinian people and on Israel's practices in the occupied territories and its aggressions against Lebanon, and in particular:

General Assembly resolution 194 of 11 December 1948 which called upon Israel to facilitate the return of the Palestinian refugees, and the numerous subsequent resolutions reaffirming it;

–  Several resolutions demanding Israeli withdrawal from the territories occupied since June 1967;

Resolutions demanding the termination of the programme of establishing settlements in the occupied territories and the dismantling of existing ones, in particular UN Security Council resolution 465 of 1980;

–  Resolutions relevant to Jerusalem, and in particular Security Council resolution 476 of 1980 which strongly deplored the Basic Law enacted by the Israeli Parliament concerning the annexation of Jerusalem to Israel and considered this annexation null and void, and resolution 478 which deplored Israel's refusal to implement the previous resolution;

Resolutions denouncing Israel's oppression of Palestinian Arabs and demanding the application of the Geneva Conventions in the occupied territories, which amount to twenty-six resolutions adopted by the General Assembly, the latest of which was resolution 35/122 of 11 December 1980, and four other resolutions adopted by the Security Council;

Successive Security Council resolutions on Israeli aggressions against Lebanon, including resolutions 425, 426, 427, 434 of 1978; 444, 450 and 459 of 1979; and 476 of 1980;

Noting with great concern that these and similar resolutions, which total 150, have changed nothing in Israel's behaviour and that the Israeli Government has always declared its refusal to comply with them,

Reaffirming that Israel's persistence in occupying Palestinian and other Arab territories since 1967 and in violating the rights of the Palestinian people constitutes a flagrant violation of the UN Charter, the Universal Declaration of Human Rights and the Fourth Geneva Convention, exacerbates tension in the region and threatens international peace and security,

Recognizing the importance of any effort made in favour of a just, comprehensive and lasting peace in the Middle East,

Considering that the question of Palestine is the crux of the conflict in the Middle East,

Considering that the establishment of a just, comprehensive and lasting peace in the Middle East is essential for all the peoples of that area, for the respect of the sovereignty of their countries, including the Palestinian State, for the security of the Mediterranean basin and of the Red Sea, and for the maintenance of world peace,

Affirming that a just and lasting peace in the area must be based on:

(i) The unconditional Israeli withdrawal from all the Arab territories occupied since 1967, including Jerusalem and the Golan Heights;

(ii) The enabling of Palestinian refugees to return to their homes and recover their property;

(iii) The enabling of the Palestinian people to exercise their right to self-determination and to establish their independent State on their national soil;

(iv) The recognition that the PLO is the sole and legitimate representative of the Palestinian people and that it should have its full role in all that is related to the question of Palestine and the Middle East problem;

(v) The mutual and simultaneous recognition of the State of Israel and the PLO;

Deploring the continuation by Israel, since 1968, of air, sea and land raids on Lebanese towns and villages, including the capital, Beirut, and on Palestinian refugee camps, thus causing loss of life and other casualties, destruction of property and paralyzing peaceful life, especially in southern Lebanon, and noting with great concern the escalation of the raids launched by the Israeli air force on Beirut last July, resulting in a great number of civilian casualties,

Noting with satisfaction the cease-fire agreement in southern Lebanon and the necessity to increase the possibilities of the UN forces (UNIFIL) in order to enable them to carry out their mission as defined by UN Security Council resolution 425 and subsequent resolutions,

Deeply deploring the danger to -international peace and security created by the premeditated Israeli attack on Iraqi nuclear installations on 7 June 1981 which could at any time explode the situation in the area, with grave consequences for the vital interests of all^States,

Rejecting Israel's aggressive policy of basing its security on preemptive war and territorial expansion,

1.  Deeply deplores Israel's insistence on rejecting the UN and IPU resolutions and its persistence in pursuing practices which contradict the UN Charter and the Universal Declaration of Human Rights, and calls upon Israel once more immediately to implement the UN and IPU resolutions relating to the question of Palestine and the Middle East crisis;

2.  Denounces the continued Israeli occupation of the Palestinian and other Arab territories since 1967 and demands Israel's immediate, total and unconditional withdrawal from them;

3.  Condemns the Israeli Parliament's decision declaring Jerusalem as the capital of Israel and calls for that decision to be revoked, considering null and void the annexation of Jerusalem;

4.  Condemns Israel for blocking the return of Arab refugees to their homes and demands that Israel facilitate their return and the recovery of their property;

5.  Condemns Israel's continued policy of establishing settlements and demands that it desist from this policy and evict the settlers from the occupied Palestinian and Arab territories;

6.  Reproves Israel for its repressive practices regarding the inhabitants of the occupied territories, and calls upon Israel to allow the return of deportees, to release the detainees arrested for resisting the occupation, to refrain from the policy of terrorism practised by the occupation authorities, to put an end to the illegal exploitation of natural resources and to refrain from changing the geographic and demo-graphic character of the country and from restricting the practice of religious rites in Moslem and Christian holy places;

7.  Strongly deplores raids during which Israel used various weapons against Arab States, particularly in the attacks on Lebanon murdering innocent civilians, and demands that Israel stop these aggressions and respect Lebanon's sovereignty, integrity and international borders;

8.  Calls upon the permanent members of the UN Security Council to refrain from using their right of veto in order to support or give cover to Israel and other countries which violate UN resolutions;

9.  Demands that the Parliaments and Governments of the world deplore and denounce Israel's aggressive practices referred to in this resolution and exert pressure to force Israel to abide by the resolutions of the United Nations and other international organizations;

10.  Calls on all Parliaments to use their influence on their respective Governments in order to maintain the cease-fire in southern Lebanon and to give the United Nations forces (UNIFIL) more extensive prerogatives enabling them to implement fully the provisions of Security Council resolution 425 and all subsequent resolutions on this subject;

11.  Calls upon all States of the world to terminate to Israel any assistance or co-operation which may be used by it to continue its illegal occupation of Arab territories and its violation of human rights;

12.  Calls upon all parties concerned, including the PLO, to enter immediately into negotiations aimed at establishing a just, comprehensive and lasting peace in the Middle East.
