Definitions

1. In this declaration

"The map" – The map, dimensions of which are 1: 150,000,

bearing the name "Declaration Concerning Closing Area Number s/2/03 (seam area),” signed by myself and forming an integral part of this declaration.

"Israeli" – Each one of the following:

a. Citizen of the State of Israel;

b. Resident of the State of Israel, registered in the population registry of Israel in accordance with the Population Registry Law, 1965, and as amended in Israel from time to time.

c. One who is eligible to emigrate to Israel in accordance with the Law of Return, 1950, and as amended in Israel from time to time.

"The obstacle" – fences, walls and patrol paths, which are intended to prevent terror attacks and the exit of attackers from the Judea and Samaria region into the State of Israel, that were erected under the authority of the confiscation orders detailed in Part A of the attachment to this declaration, and as is amended from time to time.

"Seam area" – All of the area surrounded by the obstacle,

marked on the map with the color red, in the direction of the State of Israel.

Closure of

2. I declare that the seam area is a closed zone as intended by this declaration.

3. a. No person will enter the seam area and no one will remain there.

b. A person found in the seam area will be required to evacuate it immediately.

Reservation of

4. a. Article 3 of the declaration will not be applicable for:

b. Despite the aforementioned in sub-article (a), the military commander is authorized to

determine that the directive of article 3 of this declaration will apply to a person or a type of persons who enter the seam area or who remain there.

Permanent

Residents

5. a. A person, who has reached the age of 16, whose permanent place of residence on the date of entry into force of this declaration is in the seam area, will be eligible to enter the seam area and remain there, so long as he possesses a written permit given to him by me or one authorized by me, which testifies to the fact that his permanent place of residence is in the seam area, and this is all in accordance with the conditions determined in the permit.

b. 1. A person, who has not reached the age of 16, whose place of permanent residence

is the seam area, will be eligible to remain in the seam area without a written permit as stipulated in sub-article (a).

2. A person, who has not reached the age of 16, whose place of permanent residence

is the seam area, will be eligible to enter the seam area in one of the following

ways:

6. a. Entry into the region and exit from it will be via passageways detailed in Part B of the attachment to this declaration, and marked in the color blue on the map, and all in accordance with the conditions to be determined by me or one authorized by me.

Authorisation

7. The Head of the Civil Administration is authorized to determine directives and arrangements in all matters concerning this declaration.

Publication

8. a. Copies of this declaration and the attached map will be placed for the review of all persons during regular working hours in the following offices:

1. The regional District Coordinating Offices (DCO);

2. The police station in the Judea and Samaria region;

3. Office of the Legal Advisor of the Judea and Samaria region;

4. Offices of the Head of the Infrastructure Unit of the Civil Administration in the Judea and Samaria region.

b. Copies of the declaration and the attached map will be hung on the notice boards of the regional DCO offices, as noted in sub-article (a)(1), for a period of three months from the date of publication of the notice concerning the signature on this declaration.

c. The Head of the Civil Administration is eligible to determine additional means of publication, apart from those detailed in sub-articles (a) and (b).

Laws

9. This declaration will not impair the applicability of declarations concerning the closure of territory or other orders applicable in the seam area.

Entry into

10. The date of entry into force of this declaration is the date of its signature.

The Name

11. This declaration will be entitled: "Declaration in the Matter of Closing Territory Number s/2/03 (seam area) (Judea and Samaria), 2003".
