(in pursuance of General Assembly resolution 40/161 A)

Addendum

On 24 July 1986, the Permanent Representative of Israel to the United Nations addressed the following note verbale to the Secretary-General:

"The Permanent Representative of Israel to the United Nations presents his compliments to the Secretary-General and has the honour to refer to the note verbale of the Acting Permanent Representative of Israel of 2 July 1986.  Regarding General Assembly resolution 40/161 A, the Acting Permanent Representative of Israel indicated that upon the completion of Abu Eain's trial, the results would be forwarded to the Secretary-General.

"On 21 July 1986 Abu Eain was found guilty of the following criminal acts:

"1. Organization of and participation in subversive activities.

"2. Organization of hostile propaganda and incitement to violence.

"3. Conspiracy with the intent to carry out a felony (the hijacking of a bus).

"4. Attempts to solicit and engage others in criminal acts.

"Abu Eain's guilt was clear established in due process of law.  He was sentenced to 33 months in jail with an additional 21-month conditional sentence.

"In view of these facts, Israel expressly rejects resolution 40/161 A and continues to believe it should be dropped from the General Assembly's agenda."
