The Secretary-General has responded to a letter from the Guatemalan Government regarding the International Commission against Impunity in Guatemala (CICIG), the independent mechanism created by an Agreement between the United Nations and the Government of Guatemala. Under the Agreement, the Secretary-General appoints the Commissioner of CICIG. The letter was sent after the Guatemalan Constitutional Court ruled unanimously to allow the return of the CICIG Commissioner to Guatemala.
CICIG has been widely considered successful in supporting national efforts to fight impunity and strengthening national institutions responsible for investigating and prosecuting crimes within its mandate and the Secretary-General sees no reason to change his existing position of support for Commissioner Iván Velásquez.
The UN Secretariat has been engaged in discussions with the Guatemalan Government to develop means of addressing its concerns regarding CICIG’s performance. It and remains open to continuing those discussions, within the terms of the Agreement.

El Secretario General ha respondido a la carta del Gobierno de Guatemala en relación con la Comisión Internacional contra la Impunidad en Guatemala (CICIG), el mecanismo independiente creado por un Acuerdo entre las Naciones Unidas y el Gobierno de Guatemala. Según el Acuerdo, el Secretario General es quien nombra al Comisionado de la CICIG. La carta fue enviada después de que el Tribunal Constitucional de Guatemala dictaminó unánimemente permitir el regreso del Comisionado de la CICIG a Guatemala.
La CICIG ha sido considerada ampliamente exitosa en su apoyo a los esfuerzos nacionales para combatir la impunidad y fortalecer las instituciones nacionales encargadas de investigar y enjuiciar crímenes dentro de su mandato y el Secretario General no ve ningún motivo para cambiar su posición actual de apoyo al Comisionado Iván Velásquez.
La Secretaría de la ONU ha mantenido conversaciones con el gobierno de Guatemala para desarrollar formas de abordar sus preocupaciones con respecto al desempeño de la CICIG. Permanece abierto para continuar esas discusiones, dentro de los términos del Acuerdo.
