Since the applicant was not a staff member of UNOV when the contested decision was taken, the decision to bar him from access to the VIC did not affect and could not have affected his terms of appointment. The decision could be contested neither before the JAB nor before the UNDT.

The application deals with the decision taken by UNOV to bar the applicant from access to the Vienna International Centre (VIC) in October 1999. The applicant was a former staff member of UNOV and he held a Special Service Agreement (SSA) with UNIDO at the time the decision was taken. The applicant initiated arbitration proceedings challenging the contested decision (the recourse provided for in the SSA), which resulted in a settlement of the dispute. In 2008, the applicant contested the same decision before the former JAB; his case was transferred to UNDT in July 2009.
