The UN Secretariat is deploying a team of three United Nations experts to Honduras on 10 July to provide technical assistance regarding the future establishment of an international, impartial, independent and autonomous mechanism against corruption and impunity, in accordance with the Memorandum of Understanding signed in December 2022 between the UN Secretariat and the Government of Honduras. The team of experts of the United Nations will assess existing national instruments, institutions and capacities for the fight against impunity and corruption and their prosecution; contribute to the provision of support and technical assistance; and identify the necessary constitutional, legal and administrative reforms within the Honduran legal system for the possible establishment of an international, impartial, independent and autonomous mechanism. The work of the UN team of experts is of a technical nature. The experts will engage with a wide variety of actors.
 
The future international, impartial, independent and autonomous mechanism will only come into being when: (a) the UN Secretariat and the Government of Honduras agree in writing on the existence of minimum legal guarantees and requirements for its operation, (b) an intergovernmental body of the United Nations has granted a mandate, and (c) the bilateral agreement negotiated between the UN and the Government of Honduras enters into force. At that point, and to guarantee its independence, impartiality and autonomy, the mechanism’s leadership would be appointed by the Secretary-General.

The UN Secretariat remains committed to supporting Honduras in its efforts to fight impunity and strengthen rule of law institutions.
 

 
La Secretaría de la ONU desplegará a Honduras un equipo de tres expertos de las Naciones Unidas el 10 de julio, para brindar asistencia técnica en relación con el futuro establecimiento de un mecanismo internacional, imparcial, independiente y autónomo contra la corrupción y la impunidad, de conformidad con el Memorando de Entendimiento firmado en diciembre de 2022 entre la Secretaría de la ONU y el Gobierno de Honduras. El equipo de expertos de las Naciones Unidas evaluará los instrumentos, instituciones y capacidades nacionales existentes para la lucha contra la impunidad y la corrupción y su enjuiciamiento; contribuirá a actividades de asesoría y asistencia técnica; e identificará las reformas constitucionales, legales y administrativas necesarias dentro del ordenamiento jurídico hondureño para el posible establecimiento de un mecanismo internacional, imparcial, independiente y autónomo. El trabajo del equipo de expertos de la ONU es de naturaleza técnica y se desarrollará involucrando a una amplia variedad de actores.

El futuro mecanismo internacional, imparcial, independiente y autónomo sólo dará inicio cuando: (a) el Secretariado de la ONU y el Gobierno de Honduras acuerden por escrito la existencia de garantías legales mínimas y requisitos para su funcionamiento, (b) un organismo intergubernamental de las Naciones Unidas haya otorgado un mandato y (c) el acuerdo bilateral negociado entre la ONU y el Gobierno de Honduras entre en vigor. En ese momento, y para garantizar su independencia, imparcialidad y autonomía, la dirección del mecanismo sería designada por el Secretario General.
 
La Secretaría de la ONU continúa comprometida con apoyar a Honduras en sus esfuerzos para combatir la impunidad y fortalecer las instituciones del Estado de derecho.
