The Secretary-General deeply regrets that, on 5 February, the transitional Government of Mali declared the Director of the Human Rights Division of the United Nations Multidimensional Integrated Stabilization Mission in Mali (MINUSMA), and representative of the United Nations High Commissioner for Human Rights, as persona non grata.
 
In the context of the political transition towards a return to constitutional order in Mali, the Secretary-General underscores the critical need for the Malian authorities to protect human rights including in particular freedom of expression, which is crucial for the functioning of a democratic society.
 
The Secretary-General has full confidence in MINUSMA and the commitment and professionalism of its personnel to implement the mission’s mandate to support Mali and its people, including in the promotion and protection of human rights. He notes that the doctrine of “persona non grata” is not applicable to United Nations personnel and is contrary to the legal framework applicable to the United Nations, including with respect to obligations under the Charter of the UN and those concerning the privileges and immunities of the UN and its personnel.

Le Secrétaire général regrette profondément que, le 5 février, le Gouvernement de transition du Mali ait déclaré persona non grata le Directeur de la Division des droits de l'homme de la Mission multidimensionnelle intégrée des Nations Unies pour la stabilisation au Mali (MINUSMA) et représentant du Haut Commissaire des Nations Unies aux droits de l'homme.

Dans le contexte de la transition politique vers le retour à l'ordre constitutionnel au Mali, le Secrétaire général souligne la nécessité pour les autorités maliennes de protéger les droits de l’homme et notamment la liberté d'expression, indispensable au fonctionnement d'une société démocratique.
 
Le Secrétaire général a pleinement confiance en la MINUSMA, ainsi qu'en l'engagement et le professionnalisme de son personnel pour mettre en œuvre le mandat de la mission visant à soutenir le Mali et son peuple, y compris dans la promotion et la protection des droits de l’homme. Il note que la doctrine de la « persona non grata » n'est pas applicable au personnel des Nations Unies et est contraire au cadre juridique applicable aux Nations Unies, y compris en ce qui concerne les obligations découlant de la Charte des Nations Unies et celles concernant les privilèges et immunités de l'ONU et son personnel.
