Germany)<\/strong><\/p>\n<p style=\"text-align: center\"><strong>Request for the indication of provisional measures<\/strong><\/p>\n<p style=\"text-align: center\"><strong>The Court finds that the circumstances do not require the exercise of its power to indicate <\/strong><br \/>\n<strong>provisional measures<\/strong><\/p>\n<p style=\"text-align: left\">THE HAGUE, 30 April 2024. The International Court of Justice today delivered its Order on the Request for the indication of provisional measures submitted by Nicaragua in the case concerning Alleged Breaches of Certain International Obligations in respect of the Occupied Palestinian Territory (Nicaragua v. Germany).<\/p>\n<p style=\"text-align: left\">Nicaragua requested the Court to indicate provisional measures, pending the Court\u2019s determination on the merits of the case, with respect to Germany\u2019s \u201cparticipation in the ongoing plausible genocide and serious breaches of international humanitarian law and other peremptory norms of general international law occurring in the Gaza Strip\u201d.<\/p>\n<p style=\"text-align: left\">In its Order, the Court:<\/p>\n<p style=\"text-align: left;padding-left: 40px\">\u201cBy fifteen votes to one,<\/p>\n<p style=\"text-align: left;padding-left: 40px\">Finds that the circumstances, as they now present themselves to the Court, are not such as to require the exercise of its power under Article 41 of the Statute to indicate provisional measures.<\/p>\n<p style=\"text-align: left\">IN FAVOUR: President Salam; Vice-President Sebutinde; Judges Tomka, Abraham, Yusuf, Xue, Bhandari, Iwasawa, Nolte, Charlesworth, Brant, G\u00f3mez Robledo, Cleveland, Aurescu, Tladi;<\/p>\n<p style=\"text-align: left\">AGAINST: Judge ad hoc Al-Khasawneh.\u201d<\/p>\n<p style=\"text-align: left\">The Court also recalls its Order of 26 January 2024 and Order of 28 March 2024, delivered in the case concerning Application of the Convention on the Prevention and Punishment of the Crime of Genocide in the Gaza Strip (South Africa v. Israel), in which it affirmed that it remains deeply concerned about the situation in Gaza. The Court furthermore considers that it is<\/p>\n<p style=\"text-align: left\">\u201cparticularly important to remind all States of their international obligations relating to the transfer of arms to parties to an armed conflict, in order to avoid the risk that such arms might be used to violate the [Genocide Convention and the 1949 Geneva] Conventions [on international humanitarian law]\u201d,<\/p>\n<p style=\"text-align: left\">and that \u201call these obligations are incumbent upon Germany as a State party to the said Conventions in its supply of arms to Israel\u201d.<\/p>\n<p style=\"text-align: left\">The Court also reaffirms that the decision given in the present proceedings in no way prejudges the question of the jurisdiction of the Court to deal with the merits of the case or any questions relating to the admissibility of the Application or to the merits themselves.
