{"id":214458,"date":"2019-03-18T14:40:41","date_gmt":"2019-03-18T18:40:41","guid":{"rendered":"https:\/\/www.un.org\/unispal\/?post_type=document&#038;p=214458"},"modified":"2019-06-04T14:45:56","modified_gmt":"2019-06-04T18:45:56","slug":"israels-exploitation-of-palestinian-resources-is-human-rights-violation-says-un-special-rapporteur-for-the-situation-of-human-rights-in-the-opt-press-release","status":"publish","type":"document","link":"https:\/\/www.un.org\/unispal\/document\/israels-exploitation-of-palestinian-resources-is-human-rights-violation-says-un-special-rapporteur-for-the-situation-of-human-rights-in-the-opt-press-release\/","title":{"rendered":"Israel\u2019s Exploitation of Palestinian Resources is Human Rights Violation, Says UN Special Rapporteur for the Situation of Human Rights in the OPT \u2013 Press Release"},"content":{"rendered":"<p><span style=\"color: black; font-family: 'Roboto',serif; font-size: 10.5pt;\">GENEVA (18 March 2019) \u2013 Israel\u2019s exploitation of natural resources in the Occupied Palestinian Territory for its own use is in direct violation of its legal responsibilities as an occupying power, says UN Special Rapporteur Michael Lynk.<\/span><\/p>\n<p><span style=\"color: black; font-family: 'Roboto',serif; font-size: 10.5pt;\">\u201cFor nearly five million Palestinians living under occupation, the degradation of their water supply, the exploitation of their natural resources and the defacing of their environment, are symptomatic of the lack of any meaningful control they have over their daily lives,\u201d Lynk said presenting a\u00a0<\/span><span style=\"color: #03a9f4; font-family: 'Roboto',serif; font-size: 10.5pt;\"><a href=\"https:\/\/www.un.org\/unispal\/document\/report-of-the-special-rapporteur-on-the-situation-of-human-rights-in-the-palestinian-territories-occupied-since-1967-advance-unedited-version-2\/\">report<\/a><\/span><span style=\"color: black; font-family: 'Roboto',serif; font-size: 10.5pt;\">\u00a0to the Human Rights Council in Geneva.<\/span><\/p>\n<p><span style=\"color: black; font-family: 'Roboto',serif; font-size: 10.5pt;\">\u201cIsrael\u2019s policy of usurping Palestinian natural resources and disregarding the environment has robbed the Palestinians of vital assets, and means they simply cannot enjoy their right to development.<\/span><\/p>\n<p><span style=\"color: black; font-family: 'Roboto',serif; font-size: 10.5pt;\">\u201cIts approach to the natural resources of the Occupied Palestinian Territory has been to use them as a sovereign country would use its own assets, with vastly discriminatory consequences.\u201d<\/span><\/p>\n<p><span style=\"color: black; font-family: 'Roboto',serif; font-size: 10.5pt;\">The report, focusing on the impact of the occupation on the environment and natural resources, said people living under occupation should be able to enjoy the full panoply of human rights enshrined in international law, in order to protect their sovereignty over their natural wealth.<\/span><\/p>\n<p><span style=\"color: black; font-family: 'Roboto',serif; font-size: 10.5pt;\">\u201cHowever, Israeli practices in relation to water, extraction of other resources, and environmental protection, raise serious concerns.<\/span><\/p>\n<p><span style=\"color: black; font-family: 'Roboto',serif; font-size: 10.5pt;\">\u201cWith the collapse of natural sources of drinking water in Gaza and the inability of Palestinians to access most of their water sources in the West Bank, water has become a potent symbol of the systematic violation of human rights in the Occupied Palestinian Territory,\u201d the Special Rapporteur said.<\/span><\/p>\n<p><span style=\"color: black; font-family: 'Roboto',serif; font-size: 10.5pt;\">\u201cAs of 2017, more than 96% of Gaza\u2019s coastal aquifer \u2013 the main source of water for residents of Gaza \u2013 has become unfit for human consumption. The reasons include over-extraction because of Gaza\u2019s extremely dense population, contamination with sewage and seawater, Israel\u2019s 12-year old blockade, and asymmetrical wars which has left Gaza\u2019s infrastructure severely crippled and with a near-constant electricity shortage.<\/span><\/p>\n<p><span style=\"color: black; font-family: 'Roboto',serif; font-size: 10.5pt;\">The Rapporteur said natural and mineral wealth from the Dead Sea, which is partly within the occupied West Bank, were being extracted by Israel for its own benefit, while the Palestinians were denied any access to those resources.<\/span><\/p>\n<p><span style=\"color: black; font-family: 'Roboto',serif; font-size: 10.5pt;\">\u201cStates are obligated to ensure that the enjoyment of human rights is not affected by environmental harm, and to adopt legal and institutional frameworks that protect against any environmental damage that interferes with the enjoyment of human rights,\u201d Lynk said.<\/span><\/p>\n<p><span style=\"color: black; font-family: 'Roboto',serif; font-size: 10.5pt;\">There are serious concerns about Israel\u2019s practice of disposing of hazardous waste in so-called \u201csacrifice zones\u201d in the West Bank. The impact of Israel\u2019s practices may be felt not only by Palestinians, but also by Israelis and others in the region, the Rapporteur said.<\/span><\/p>\n<p><span style=\"color: black; font-family: 'Roboto',serif; font-size: 10.5pt;\">The report also questioned the ongoing use of excessive force by Israeli security forces against demonstrators in Gaza, and the near humanitarian catastrophe in the territory caused by the blockade.<\/span><\/p>\n<p><span style=\"color: black; font-family: 'Roboto',serif; font-size: 10.5pt;\">Lynk also expressed fears about the fate of Palestinian families in East Jerusalem \u2013 nearly 200 of whom are at risk of forced eviction \u2013 and concern for human rights defenders facing increasing attacks on their credibility and pressure on funding.<\/span><\/p>\n<p><span style=\"color: black; font-family: 'Roboto',serif; font-size: 10.5pt;\">\u201cWe must understand that these issues and violations block any visible path to Palestinian self-determination, and are instead leading to a darker future that heralds danger to both peoples,\u201d he said.<\/span><\/p>\n<p><span style=\"color: black; font-family: 'Roboto',serif; font-size: 10.5pt;\">ENDS<\/span><\/p>\n<p><strong><i><span style=\"color: black; font-family: 'Roboto',serif; font-size: 10.5pt;\">Mr. Michael Lynk<\/span><\/i><\/strong><em><span style=\"color: black; font-family: 'Roboto',serif; font-size: 10.5pt;\">\u00a0was designated by the UN Human Rights Council in 2016 as the\u00a0<\/span><\/em><em><span style=\"color: #03a9f4; font-family: 'Roboto',serif; font-size: 10.5pt;\"><a href=\"https:\/\/www.ohchr.org\/EN\/HRBodies\/SP\/CountriesMandates\/PS\/Pages\/SRPalestine.aspx\">Special Rapporteur on the situation of human rights in the Palestinian Territory occupied since 1967<\/a><\/span><\/em><em><span style=\"color: black; font-family: 'Roboto',serif; font-size: 10.5pt;\">. The mandate was originally established in 1993 by the then UN Commission on Human Rights.\u00a0Professor Lynk is Associate Professor of Law at Western University in London, Ontario, where he teaches labour law, constitutional law and human rights law. Before becoming an academic, he practiced labour law and refugee law for a decade in Ottawa and Toronto. He also worked for the United Nations on human rights and refugee issues in Jerusalem.<\/span><\/em><\/p>\n<p><em><span style=\"color: black; font-family: 'Roboto',serif; font-size: 10.5pt;\">The Special Rapporteurs are part of what is known as the\u00a0<\/span><\/em><em><span style=\"color: #03a9f4; font-family: 'Roboto',serif; font-size: 10.5pt;\"><a href=\"https:\/\/www.ohchr.org\/EN\/HRBodies\/SP\/CountriesMandates\/PS\/Pages\/SRPalestine.aspx\">Special Procedures<\/a><\/span><\/em><em><span style=\"color: black; font-family: 'Roboto',serif; font-size: 10.5pt;\">of the Human Rights Council. Special Procedures, the largest body of independent experts in the UN Human Rights system, is the general name of the Council\u2019s independent fact-finding and monitoring mechanisms that address either specific country situations or thematic issues in all parts of the world.
