UN expert highlights “disproportionate effect on children of the prolonged Israeli occupation”<\/strong><\/p><\/div>\n

Amman – The UN Special Rapporteur on the occupied Palestinian territories, Richard Falk, has warned the international community about the dire human rights situation faced by Palestinian children.<\/p><\/div>\n

<\/p>\n

\n

At the end of an eight-day visit to Cairo and Amman, the UN Special Rapporteur on the situation of human rights in Palestinian territories occupied since 1967 <\/span>said<\/a> the “rapidly deteriorating human rights situation as a result of the prolonged Israeli occupation disproportionately affects children.”<\/span><\/p><\/div>\n

<\/p>\n

\n

“Since the year 2000, 1,335 Palestinian children have been killed as a result of Israeli military and settler presence in the occupied Palestinian territory. The arbitrary opening of fire by Israeli military against Palestinian children is appalling,” Falk said.<\/p><\/div>\n

<\/p>\n

\n

“The policies of land confiscation, expansion of settlements, home demolitions and forced displacement of families, revocation of residency permits and restrictions on freedom of movement continue to have a greater impact on children.”<\/p><\/div>\n

<\/p>\n

\n

“Children are particularly vulnerable to settlers’ violent attacks and harassment. In Gaza, the continued Israeli blockade has significantly affected the right of children to food, health and education. Psychological trauma from the Israeli attack on Gaza in December 2008-January 2009 continues to affect children more disproportionately.”<\/p><\/div>\n

<\/p>\n

Falk added that Israel continues to arbitrarily arrest, detain and abuse children, noting that 226 children are currently in Israeli detention, including 45 who are between 12 and 15 years old.<\/p><\/div>\n

<\/p>\n

\n

“Children continue to be arrested at night, at checkpoints or off the street. Upon arrest, children and their families are seldom informed of the charges against them,” he said. “Arresting children for stone throwing, particularly in East Jerusalem, has been on the rise. Children report that they were blindfolded, beaten or kicked at the time of arrest and put at the back of a military vehicle where they were subject to further physical and psychological abuse on the way to the interrogation and detention center. It is noteworthy that the perpetrators of these violations against Palestinian children face no accountability for their actions.” <\/p><\/div>\n

The Special Rapporteur said that, unlike Israeli juvenile offenders, Palestinian children are tried in the Juvenile Military Court.<\/p><\/div>\n

<\/p>\n

\n

“Palestinian children continue to be deprived of their right to education. Existing schools are massively inadequate for the growing needs of students,” he said. “The planning restrictions in place in the West Bank, along with extreme difficulties that make it impossible to obtain permits to build new schools, force the communities to build classrooms illegally and risk demolition.”<\/p><\/div>\n

Falk cited figures indicating that there was a shortage of 40,000 classrooms at the beginning of 2010-2011 school year. He added that Bedouin herding families living in Area C of the West Bank and their children are particularly vulnerable to a range of violations by Israeli authorities. <\/p><\/div>\n

<\/p>\n

The UN expert stressed that the international community “should spare no effort in compelling Israel to comply with its obligations under international humanitarian and human rights law, end this prolonged and illegal occupation and fully respect the right to self-determination of the Palestinian people.”<\/p><\/div>\n

<\/p>\n

“My hope was to visit the occupied territory personally, to assess the human rights situation of the Palestinian population living under occupation in the West Bank, including East Jerusalem, and the Gaza Strip,” he said.<\/p><\/div>\n

<\/p>\n

\n

“Since my appointment in May 2008, the Israeli authorities have prevented me from visiting the occupied Palestinian territory in violation of their obligations as a UN member state.”<\/p><\/div>\n

Falk was also due to visit the Gaza Strip but had to cancel due to the security situation there. He noted plans to visit Gaza later this year. Falk thanked the governments of Egypt and Jordan for having welcomed his visit to the region.<\/p><\/div>\n

“I was able to learn a great deal about the extraordinary transformations taking place across the Arab world, particularly in Egypt,” he said. “I found new hope for how these revolutionary processes may reverse the longstanding paralysis and global inability to end the prolonged and illegal Israeli occupation, and to realize Palestinians’ human rights.” <\/p><\/div>\n

\n\t\t\t\tأشكركم على منحي الفرصة لأنقل إليكم بعض الانطباعات الأولية بعد زيارتي الأسبوع الماضي للقاهرة وعمان في إطار توسيع مهمتي كمقرر عام للأمم المتحدة حول أوضاع حقوق الإنسان في الأراضي الفلسطينية المحتلة منذ عام1967. وكنت آمل أثناء هذه المهمة والمهمات السابقة أن أزور الأراضي المحتلة شخصياً لتقييم أوضاع حقوق الإنسان للشعب الفلسطيني الذي يعيش تحت الاحتلال في الضفة الغربية، بما في ذلك القدس الشرقية، وقطاع غزة.\n\t\t\t\t<\/div>\n
\n\t\t\t\tكما تعرفون، فمنذ تعييني كمقرر خاص للأمم المتحدة في أيار 2008، قامت السلطات الإسرائيلية بمنعي من زيارة الأراضي الفلسطينية المحتلة منتهكة بذلك التزاماتها كدولة عضو في الأمم المتحدة، مما أعاق تنفيذ التفويض الذي منحني إياه مجلس حقوق الإنسان التابع للأمم المتحدة. فعندما حاولت القيام بزيارتي الميدانية الأولى في 14 كانون أول 2008، وحال وصولي إلى إسرائيل، لم يسمح لي بالدخول وجرى طردي بعد ذلك. ولم يكن هناك أي إشارة على رغبة الحكومة الإسرائيلية بالسماح لي بالدخول في المستقبل. ولذلك، فإنني اشكر حكومتي مصر والأردن على الترحيب بزيارتي للمنطقة.\n\t\t\t\t<\/div>\n
\n\t\t\t\tأثناء المهمة الحالية، كنت أنوي زيارة قطاع غزة المحتل، ولكنني اضطررت لإلغاء الزيارة بسبب تقدير الأمم المتحدة للأوضاع الأمنية في غزة. وأنوي زيارة غزة لاحقا في عام 2011.\n\t\t\t\t<\/div>\n
\n\t\t\t\tبالرغم من عدم تمكني من زيارة الأراضي الفلسطينية المحتلة في هذه الرحلة، فقد سعيت للحصول على تقييم لأوضاع حقوق الإنسان في الأراضي المحتلة من خلال اللقاءات مع المسؤولين الحكوميين والأكاديميين ومنظمات المجتمع المدني والمدافعين عن حقوق الإنسان ومنظمات الأمم المتحدة. وقد ركزت بشكل خاص على تأثير الاحتلال والحصار واستمرار أوضاع اللاجئين على ما هي عليه لمدة طويلة على الحقوق الأساسية للأطفال. كما تداولت مع من التقيتهم تأثير الحصار على غزة على الصحة النفسية والجسدية ونمو الأطفال في غزة. وقد وجدت أنّ التدهور السريع للأوضاع المتصلة بحقوق الإنسان نتيجة الاحتلال الإسرائيلي المستمر قد ترك آثاراً جسيمة على الأطفال.\n\t\t\t\t<\/div>\n
\n\t\t\t\tوفي الجانب  الإيجابي، فقد تمكنت من معرفة كثير من المعلومات عن التحولات غير العادية الجارية في الوطن العربي، وتحديدا في مصر. فقد بعثت فيّ الأمل حول قدرة هذه العمليات الثورية على إنهاء حالة الشلل الطويلة وعدم قدرة المجتمع الدولي على إنهاء الاحتلال الاسرائيلي المستمر وغير القانوني وتأمين حقوق الإنسان للشعب الفلسطيني.\n\t\t\t\t<\/div>\n
\n\t\t\t\tوما تزال أوضاع حقوق الانسان في جميع الأراضي الفلسطينية المحتلة متردّية. فسياسة مصادرة الاراضي وتوسيع المستوطنات وهدم المنازل وإجبار العائلات على ترك منازلها بالإضافة إلى سحب تصاريح الإقامة والقيود المفروضة على حرية التنقل تلقي بظلالها على الأطفال. فالاطفال بشكل خاص هم الأكثر عرضة لهجمات المستوطنين العنيفة وتحرشاتهم. وفي غزة يؤثر الحصار الإسرائيلي المستمر بشكل كبير على حق الأطفال في الحصول على الغذاء والصحة والتعلم. وما تزال الصدمة النفسية جراء الهجوم الاسرائيلي على غزة  في كانون الأول 2008 وكانون الثاني 2009 تترك تأثيراَ  كبيراً على الأطفال.\n\t\t\t\t<\/div>\n
\n\t\t\t\tومنذ عام 2000، قتل 1355 طفل فلسطيني نتيجة الاحتلال العسكري الإسرائيلي والوجود الاستيطاني في الأراضي الفلسطينية المحتلة. فالقوات العسكرية الإسرائيلية تفتح نيرانها بشكل عشوائي على الأطفال الفلسطينين مثيرة الرعب بينهم. ومنذ اذار 2010 قام الجنود الإسرائيليون على الحدود مع قطاع غزة باستهداف 17 طفلاَ بينما كانوا يجمعون حصى البناء لمساعدة عائلاتهم فيما يعرف ب"المنطقة العازلة". ويستمر الكبار والأطفال ا في  القيام بهذا العمل الخطير نتيجة لمنع السلطات الإسرائيلية دخول مواد البناء إلى القطاع، وهناك فرص عمل قليلة متاحة.\n\t\t\t\t<\/div>\n
\n\t\t\t\tوما تزال إسرائيل مستمرة في اعتقال الأطفال بشكل تعسفي واحتجازهم وإساءة معاملتهم متاجهلة التزاماتها بموجب القانون الدولي الإنساني. فما يزال هناك 226 طفلاً في مراكز الاحتجاز الإسرائيلية من بينهم 45 طفلاً تتراوح اعمارهم بين 12-15 عاماً. وما يزال الأطفال عرضة للاعتقال ليلاً، وفي نقاط التفتيش والشوارع. وعند الاعتقال نادراً ما يتم إبلاغ الأطفال وعائلاتهم بالتهم الموجهة ضدهم. فأعداد الأطفال الذين يعتقلون بسبب رشقهم الحجارة وبخاصة في االقدس الشرقية المحتلة في ازدياد. ويذكر الأطفال أنه يتم عصب أعينهم ويتعرضون للضرب والركل لحظة الاعتقال، ثم يتم وضعهم في مؤخرة المركبة العسكرية حيث يتعرضون لمزيد من التعذيب والاساءة البدنية والنفسية في طريقهم إلى مراكز الاستجواب والحجز. فالتقارير التي ترد باستمرار عن المعاملة المهينة وغير الإنسانية التي يتعرض لها الأطفال الفلسطينيون المحتجزين والتي تصل إلى حد الاعتداء الجنسي تبعث على الصدمة والاستياء. وتؤدي مثل هذه المعاملة المهينة واللاإنسانية إلى صدمة نفسية شديدة واكتئاب وقلق وتدني التحصيل الاكاديمي. ونشير هنا إلى أنّ مرتكبي هذه المخالفات ضد الأطفال الفلسطينيين لا يتعرضون للمسائلة عن أفعالهم.\n\t\t\t\t<\/div>\n
\n\t\t\t\tوعلى عكس الأحداث المجرمين الإسرائيليين ، يخضع الأطفال الفلسطينيون للمحاكمة في محاكم الأحداث العسكرية، وتتم ادانتهم بناءاً على اعترافات انتزعت منهم باستخدام القوة والمعاملة السيئة. وعلى العكس من نظرائهم الإسرائيليين، يتم احتجاز الأطفال الفلسطينيين تحت سن السادسة عشرة في السجون الإسرائيلية ويحرمون من الفرص المناسبة للحصول على التعليم أثناء الاحتجاز. إنّ هذا التمييز في الأنظمة القانونية في التعامل مع الأحداث مؤشر على التمييز المؤسسي المنتشر والمنظم ضد الفلسطينيين، ويذكر بنظام الفصل العنصري في جنوب إفريقيا.\n\t\t\t\t<\/div>\n
\n\t\t\t\tوما يزال الأطفال الفلسطينون يحرمون من حقهم في التعليم. والمدراس الموجودة حالياً لا تتناسب أبداً مع الحاجات النمائية للطلبة. فالقيود المفروضة على التخطيط العمراني في الضفة الغربية والصعوبات الكبيرة الموجودة والتي تحول دون الحصول على تصاريح لبناء مدارس جديدة تضطر السكان لبناء غرف صفية بشكل غير قانوني مما يجعلها عرضة للهدم. وبحسب وكالة الغوث الدولية فإن 95% من مدارس الوكالة في القطاع تعمل بنظام الفترتين. وهناك 126 بناية مدرسية تستخدمها 236 "مدرسة" بشكل منفصل. وعلى أقل تقدير، هناك حاجة لتوفير 100 بناء مدرسي لهذا العام فقط، ولكن الحصار الإسرائيلي لغزة يحول دون ذلك من خلال حظر دخول مواد البناء. فمعدل مايدخل غزة يوميا من البضائع هو حمولة 230 شاحنة لسكان يبلغ مجموعهم 1.5 مليون نسمة، وهذا أقل بكثير  مما يحتاجونه علماً بأنّ بناء مدرسة جديدة واحدة فقط يتطلب حمولة 220 شاحنة من مواد البناء. وأشارت تقارير الأنروا إلى عجز وصل إلى 40000 غرفة صفية نتيجة لذلك في بداية العام الدراسي 2010-2011. وما تزال فرص الأطفال في التعليم تجابه بالقيود المفروضة على حركة التنقل في الأراضي المحتلة بما في ذلك الجدار وبوابته ونظام التصاريح ونقاط التفتيش. وبالإضافة إلى ذلك، يستمر المستوطنون في مهاجمة الأطفال والتحرش بهم وتخويفهم في طريقهم من وإلى المدرسة.\n\t\t\t\t<\/div>\n
\n\t\t\t\tوتعتبر العائلات البدوية وأطفالها والتي تقيم في المنطقة سي من الضفة الغربية الأكثر عرضة للاعتداءات. فمعظم هذه العائلات التي تعيش على الماشية  تعاني من فقر مدقع، وقد حرمت من الوصول إلى مناطق الرعي والكلأ والخدمات الصحية، وهي غير قادرة على توفير فرص التعليم لأطفالها. فهذه العائلات لا تستطيع دفع تكاليف ارسال جميع أطفالها إلى المدارس. ولهذه المشكلة تأثير أكبر على الفتيات. فقد حرمتهم السياسات الإسرائيلية من سبل العيش المستدامة، وتسعى لإجبارهم على تغيير مكان إقامتهم. وتدعم الاعتداءات الجسدية والنفسية التي يقوم بها المستوطنون مثل هذه السياسات.\n\t\t\t\t<\/div>\n
\n\t\t\t\tإنني أغادر الأردن وأنا أشعر بقوة أنّ على المجتمع الدولي أن لا يدخر جهداً لإجبار إسرائيل على  الإيفاء بالتزاماتها بموجب القانون الدولي الإنساني وقانون حقوق الانسان وإنهاء هذا الاحتلال المستمر وغير القانوني والاحترام الكامل لحق الشعب الفلسطيني في تقرير مصيره. لقد ركزت هذه الزيارة على الاوضاع السيئة للأطفال الفلسطينيين الذين يتحملون عبء الاحتلال المقيت، ولكن يجب أن أذكّر أنّ التفويض الممنوح لي  يشمل كامل حقوق الإنسان، وهي حقوق. غير القابلة للتصرف لسكان الأراضي الفلسطينية المحتلة\n\t\t\t\t<\/div>\n
