REPORT OF THE ECONOMIC AND SOCIAL COUNCIL FOR THE YEAR 1996*<\/p><\/div>\n

The report of the Council for the year 1996 is being issued in three<\/p>\n

parts and in a new format.  Part I contains the foreword by the<\/p>\n

President of the Council and chapters I-IV, relating to the<\/p>\n

high-level, coordination and operational activities segments of the<\/p>\n

work of the Council.  Part II contains chapters V-VII, which cover<\/p>\n

the general segment, elections and organizational matters.  Part III<\/p>\n

contains the annexes to the report.  The section of the report of the<\/p>\n

Council relating to the resumed substantive session of 1996 will be<\/p>\n

issued as part IV.  <\/p>\n

<\/p>\n

The resolutions and decisions adopted by the Council are included in<\/p>\n

the relevant section of the report, corresponding to the agenda item<\/p>\n

under which they were adopted, as are the summary of the President on<\/p>\n

the high-level segment (chapter II) and the agreed conclusions of the<\/p>\n

coordination segment (chapter III). <\/p>\n

\t<\/span>At its substantive session, the Council considered the question of the implementation of the Declaration on the Granting of Independence to Colonial Countries and Peoples by the specialized agencies and the international institutions associated with the United Nations (agenda item 5 (c)) at its 44th, 46th, 50th and 51st meetings, on 22, 23, 25 and 26 July 1996.  An account of the discussion is contained in the relevant summary records (E\/1996\/SR.44, 46, 50 and 51).  It had before it the following documents:<\/p><\/div>\n

\t<\/span>Welcoming<\/u> the signing by the Palestine Liberation Organization and the Government of Israel of the Declaration of Principles on Interim Self-Government Arrangements, 19<\/u>\/ in Washington, D.C., on 13 September 1993, as well as all subsequent agreements reached between the two parties,<\/p><\/div>\n

<\/p>\n

\t<\/span>Concerned<\/u> about the continuing difficult situation of Palestinian women in the occupied Palestinian territory, including Jerusalem, and about the severe consequences of continuous Israeli illegal settlements activities, as well as the harsh economic conditions and other consequences for the situation of Palestinian women and their families, resulting from the frequent closure and isolation of the occupied territory,<\/p><\/div>\n

<\/p>\n

\n

\t<\/span>1.\t<\/span>Recognizes<\/u> the gradual, positive changes that are taking place as a result of the implementation of the agreements between the two parties;<\/p><\/div>\n

<\/p>\n

\n

\t<\/span>2.\t<\/span>Reaffirms<\/u> that the Israeli occupation continues to constitute a major obstacle to the advancement and self-reliance of Palestinian women and their integration in the development planning of their society;<\/p><\/div>\n

\t<\/span>3.\t<\/span>Demands<\/u> that Israel, the occupying Power, comply fully with the provisions and principles of the Universal Declaration of Human Rights,20<\/u>\/ the Hague Conventions 21<\/u>\/ and the Geneva Convention relative to the protection of Civilian Persons in Time of War, of 12 August 1949,22<\/u>\/ in order to protect the rights of Palestinian women and their families;<\/p><\/div>\n

\t<\/span>4.\t<\/span>Calls upon<\/u> Israel to facilitate the return of all refugee and displaced Palestinian women and children to their homes and properties in the occupied Palestinian territory, in compliance with relevant United Nations resolutions;<\/p><\/div>\n

171.\t<\/span>At its substantive session, the Council considered the question of the permanent sovereignty over national resources in the occupied Palestinian and other Arab territories (agenda item 8) at its 34th, 35th and 51st meetings, on 15, 16 and 26 July 1996.  An account of the discussion is contained in the relevant summary records (E\/1996\/SR.34, 35 and 51).  The Council had before it the note by the Secretary-General transmitting the report prepared by the Economic and Social Commission for Western Asia on economic and social repercussions of the Israeli settlements on the Palestinian people in the Palestinian territory, including Jerusalem, occupied since 1967, and on the Arab population of the Syrian Golan (A\/51\/135-E\/1996\/51).<\/p><\/div>\n

\t<\/span>Guided<\/u> by the principles of the Charter of the United Nations, affirming the inadmissibility of the acquisition of territory by force and recalling Security Council resolutions 242 (1967) of 22 November 1967 and 497 (1981) of 17 December 1981,<\/p><\/div>\n

\t<\/span>Recalling<\/u> Security Council resolution 465 (1980) of 1 March 1980 and other resolutions in which the Security Council affirmed the applicability of the Geneva Convention relative to the Protection of Civilian Persons in Time of War, of 12 August 1949, 24<\/u>\/ to the occupied Palestinian territory, including Jerusalem, and other Arab territories occupied by Israel since 1967,<\/p><\/div>\n

\t<\/span>Recalling also<\/u> Security Council resolution 904 (1994) of 18 March 1994, in which, inter alia<\/u>, the Council called upon Israel, the occupying Power, to continue to take and implement measures, including, among others, confiscation of arms, with the aim of preventing illegal acts of violence by Israeli settlers, and called for measures to be taken to guarantee the safety and protection of the Palestinian civilians in the occupied territory,<\/p><\/div>\n

<\/p>\n

\t<\/span>Aware<\/u> of the negative and grave economic and social repercussions of the Israeli settlements on the Palestinian people in the Palestinian territory, including Jerusalem, occupied since 1967, and on the Arab population of the occupied Syrian Golan,<\/p><\/div>\n

<\/p>\n

\n

\t<\/span>Welcoming<\/u> the ongoing Middle East peace process started at Madrid, in particular the signing at Washington on 13 September 1993 by the Government of Israel and the Palestine Liberation Organization, the representative of the Palestinian people, of the Declaration of Principles on Interim Self-Government Arrangements, 25<\/u>\/\t<\/span> and the signing at Washington on 28 September 1995 of the Israeli-Palestinian Interim Agreement on the West Bank and Gaza Strip,<\/p><\/div>\n

\t<\/span>1.\t<\/span>Takes note<\/u> of the report prepared by the Economic and Social Commission for Western Asia;26<\/u>\/<\/p><\/div>\n

\t<\/span>2.\t<\/span>Reaffirms<\/u> that Israeli settlements in the Palestinian territory, including Jerusalem, and other Arab territories occupied since 1967 are illegal and an obstacle to economic and social development;<\/p><\/div>\n

\t<\/span>3.\t<\/span>Recognizes<\/u> the economic and social repercussions of the Israeli settlements on the Palestinian people in the Palestinian territory, including Jerusalem, occupied by Israel since 1967, and on the Arab population of the occupied Syrian Golan;<\/p><\/div>\n

\t<\/span>4.\t<\/span>Reaffirms<\/u> the inalienable right of the Palestinian people and the population of the Syrian Golan to their natural and all other economic resources, and regards any infringement thereof as being illegal;<\/p><\/div>\n

\t<\/span>5.\t<\/span>Requests<\/u> the Secretary-General to submit to the General Assembly at its fifty-second session, through the Economic and Social Council, a report on the progress made in the implementation of the present resolution.<\/p><\/div>\n

173.\t<\/span>At the 37th meeting, on 17 July, the representative of Egypt, on behalf of Algeria, 27<\/u>\/ Egypt, Jordan, Mauritania, 190<\/u>\/ Qatar, 190<\/u>\/ the Sudan, Tunisia, the United Arab Emirates 190<\/u>\/ and Yemen, 190<\/u>\/ introduced a draft resolution (E\/1996\/L.23) entitled "Economic and social repercussions of the Israeli settlements on the Palestinian people in the Palestinian territory, including Jerusalem, occupied since 1967, and on the Arab population of the occupied Syrian Golan".<\/p><\/div>\n

174.\t<\/span>At the 51st meeting, on 26 July, the Vice-President of the Council, Mr. Gerhard Walter Henze (Germany), informed the Council of the results of the informal consultations held on the draft resolution.<\/p><\/div>\n

175.\t<\/span>At the same meeting, the Council adopted the draft resolution by a recorded vote of 44 to 1, with 5 abstentions.  See Council resolution  1996\/40  (para. 172  above).   The  voting  was as follows: 28<\/u>\/<\/p><\/div>\n
