I.   INTRODUCTION<\/p><\/div>\n

<\/p>\n

1.\t<\/span>At its 3rd plenary meeting, on 20 September 1996, the General Assembly, on the recommendation of the General Committee, decided to include in the agenda of its fifty-first session the item entitled "Report of the Special Committee to Investigate Israeli Practices Affecting the Human Rights of the Palestinian People and Other Arabs of the Occupied Territories" and to allocate it to the Special Political and Decolonization Committee (Fourth Committee).<\/p><\/div>\n

<\/p>\n

\n

2.\t<\/span>The Fourth Committee considered the item at its 21st and 22nd meetings, on 25 and 27 November 1996 (see A\/C.4\/51\/SR<\/span>.21<\/a> and <\/span>22<\/a>). The general debate on the item took place at the 21st and 22nd meetings, on 25 and 27 November.<\/span><\/p><\/div>\n

4.\t<\/span>At the 21st meeting, on 25 November, the representative of Sri Lanka, Chairman of the Special Committee to Investigate Israeli Practices Affecting the Human Rights of the Palestinian People and Other Arabs of the Occupied Territories, introduced the reports of that Committee (A\/51\/99 and Add.1-3) (see A\/C.4\/51\/SR.21).<\/p><\/div>\n

5.\t<\/span>At the same meeting, the Permanent Observer of Palestine to the United Nations made a statement (see A\/C.4\/51\/SR.21).<\/p><\/div>\n

II.  CONSIDERATION OF PROPOSALS<\/p><\/div>\n

A.  Draft resolution A\/C.4\/51\/L.19<\/u><\/p><\/div>\n

<\/p>\n

6.\t<\/span>At the 22nd meeting, on 27 November, the representative of Cuba, on behalf of Bangladesh, Brunei Darussalam, Cuba, Djibouti, Egypt, Indonesia, Jordan, Malaysia, Saudi Arabia,<\/u> the Sudan, Tunisia,<\/u> the United Arab Emirates<\/u> and Yemen<\/u>, introduced a draft resolution entitled "Work of the Special Committee to Investigate Israeli Practices Affecting the Human Rights of the Palestinian People and Other Arabs of the Occupied Territories" (A\/C.4\/51\/L.19).<\/p><\/div>\n

8.\t<\/span>At the 22nd meeting, on 27 November, the representative of Cuba, on behalf of Bangladesh, Brunei Darussalam, Cuba, Djibouti, Egypt, Indonesia, Jordan, Malaysia, Saudi Arabia,<\/u> the Sudan, Tunisia,<\/u> the United Arab Emirates<\/u> and Yemen<\/u>, introduced a draft resolution entitled "Application of the Geneva Convention relative to the Protection of Civilian Persons in Time of War, of 12 August 1949, to the occupied Palestinian territory, including Jerusalem, and the other occupied Arab territories" (A\/C.4\/51\/L.20).<\/p><\/div>\n

10.\t<\/span>The Committee had before it a draft resolution entitled "Israeli settlements in the occupied Palestinian territory, including Jerusalem, and the occupied Syrian Golan" (A\/C.4\/51\/L.21), submitted by Bangladesh, Brunei Darussalam, Cuba, Djibouti, Egypt, Indonesia, Jordan, Malaysia, Saudi Arabia,<\/u> the Sudan, Tunisia,<\/u> the United Arab Emirates<\/u> and Yemen<\/u>.<\/p><\/div>\n

\n

11.\t<\/span>At the 22nd meeting, on 27 November, the representative of Cuba, on behalf of the same sponsors, introduced a revised draft resolution (A\/C.4\/51\/L.21\/Rev.1), which contained the following changes:<\/p><\/div>\n

<\/p>\n

\n

\t<\/span>(a)\t<\/span>The end of the third preambular paragraph, which had read "and to the other occupied Arab territories", was revised to read "and to the occupied Syrian Golan";<\/p><\/div>\n

<\/p>\n

\n

\t<\/span>(b)\t<\/span>Operative paragraph 1, which had read:<\/p><\/div>\n

<\/p>\n

\n\t\t\t\t\t<\/span>"1.\t<\/span>Reaffirms<\/u> that colonial Israeli settlements in the Palestinian territory, including Jerusalem, and other Arab territories occupied since 1967 are illegal and an obstacle to peace and economic and social development";\n\t\t\t\t<\/div>\n

was revised to read:<\/p><\/div>\n

12.\t<\/span>Before the vote on draft resolution A\/C.4\/51\/L.21\/Rev.1, the representative of Norway proposed an oral amendment to the fourth preambular paragraph, by which the words "Aware<\/u> of" would be replaced by the word "Welcoming<\/u>".<\/p><\/div>\n

17.\t<\/span>At the 22nd meeting, on 27 November, the representative of Cuba, on behalf of the same sponsors, introduced draft resolution A\/C.4\/51\/L.23\/Rev.1, by which a new first preambular paragraph was added, which read:<\/p><\/div>\n

\n\t\t\t\t\t<\/span>"Having considered<\/u> the reports of the Special Committee to Investigate Israeli Practices Affecting the Human Rights of the Palestinian People and Other Arabs of the Occupied Territories".\n\t\t\t\t<\/div>\n

18.\t<\/span>At the same meeting, the Committee adopted draft resolution A\/C.4\/51\/L.23\/Rev.1 by a recorded vote of 127 to 1, with 6 abstentions (see para. 19, draft resolution V).1  The voting was as follows:<\/p><\/div>\n

\t<\/span>Expressing the hope<\/u> that, with the progress of the peace process, the Israeli occupation will be brought to an end and therefore violation of the human rights of the Palestinian people will cease,<\/p><\/div>\n

\t<\/span>1.\t<\/span>Commends<\/u> the Special Committee to Investigate Israeli Practices Affecting the Human Rights of the Palestinian People and other Arabs of the Occupied Territories for its efforts in performing the tasks assigned to it by the General Assembly and for its impartiality;<\/p><\/div>\n

\t<\/span>2.\t<\/span>Demands<\/u> that Israel cooperate with the Special Committee in implementing its mandate;<\/p><\/div>\n

\t<\/span>4.\t<\/span>Expresses concern<\/u> over the recent deterioration of the situation in the occupied Palestinian territory, including Jerusalem, as a result of Israeli practices and measures and the impasse facing the Middle East peace process;<\/p><\/div>\n

\t<\/span>5.\t<\/span>Requests<\/u> the Special Committee, pending complete termination of the Israeli occupation, to continue to investigate Israeli policies and practices in the occupied Palestinian territory, including Jerusalem, and other Arab territories occupied by Israel since 1967, especially Israeli lack of compliance with the provisions of the Geneva Convention relative to the Protection of Civilian Persons in Time of War, of 12 August 1949, and to consult, as appropriate, with the International Committee of the Red Cross according to its regulations in order to ensure that the welfare and human rights of the peoples of the occupied territories are safeguarded and to report to the Secretary-General as soon as possible and whenever the need arises thereafter;<\/p><\/div>\n

\t<\/span>6.\t<\/span>Also requests<\/u> the Special Committee to submit regularly to the Secretary-General periodic reports on the current situation in the occupied Palestinian territory, including Jerusalem;<\/p><\/div>\n

\t<\/span>7.\t<\/span>Further requests<\/u> the Special Committee to continue to investigate the treatment of prisoners in the occupied Palestinian territory, including Jerusalem, and other Arab territories occupied by Israel since 1967;<\/p><\/div>\n

\t<\/span>8.\t<\/span>Requests<\/u> the Secretary-General:<\/p><\/div>\n

\t<\/span>1.\t<\/span>Calls upon<\/u> Israel, the occupying Power, to comply with the relevant resolutions on the occupied Syrian Golan, in particular Security Council resolution 497 (1981), in which the Council, inter alia<\/u>, decided that the Israeli decision to impose its laws, jurisdiction and administration on the occupied Syrian Golan was null and void and without international legal effect, and demanded that Israel, the occupying Power, should rescind forthwith its decisions;<\/p><\/div>\n

\t<\/span>2.\t<\/span>Also calls upon<\/u> Israel to desist from changing the physical character, demographic composition, institutional structure and legal status of the occupied Syrian Golan and in particular to desist from the establishment of settlements;<\/p><\/div>\n

\t<\/span>3.\t<\/span>Determines<\/u> that all legislative and administrative measures and actions taken or to be taken by Israel, the occupying Power, that purport to alter the character and legal status of the occupied Syrian Golan are null and void, constitute a flagrant violation of international law and of the Geneva Convention relative to the Protection of Civilian Persons in Time of War, of 12 August 1949, and have no legal effect;<\/p><\/div>\n

\t<\/span>4.\t<\/span>Further calls upon<\/u> Israel to desist from imposing Israeli citizenship and Israeli identity cards on the Syrian citizens in the occupied Syrian Golan, and to desist from its repressive measures against the population of the occupied Syrian Golan;<\/p><\/div>\n

\t<\/span><\/p><\/div>\n

\n

\t<\/span>5.\t<\/span>Deplores<\/u> the violations by Israel of the Geneva Convention relative to the Protection of Civilian Persons in Time of War, of 12 August 1949;<\/p><\/div>\n

\t<\/span>6.\t<\/span>Calls once again upon<\/u> Member States not to recognize any of the legislative or administrative measures and actions referred to above;<\/p><\/div>\n

\t<\/span>7.\t<\/span>Requests<\/u> the Secretary-General to report to the General Assembly at its fifty-second session on the implementation of the present resolution.<\/p><\/div>\n
