ESTABLISHMENT OF A NUCLEAR-WEAPON-FREE ZONE<\/strong><\/p><\/div>\n

IN THE REGION OF THE MIDDLE EAST<\/strong><\/p><\/div>\n

Report of the First Committee<\/u><\/strong><\/p><\/div>\n

\n

I.  INTRODUCTION<\/p><\/div>\n

<\/p>\n

\n

1.\t<\/span>The item entitled "Establishment or a nuclear-weapon-free zone in the region of the Middle East:  report of the Secretary-General" was included in the provisional agenda of the forty-first session in accordance with General Assembly resolution 40\/82 of 12 December 1985.<\/p><\/div>\n

<\/p>\n

\n

2.\t<\/span>At its 3rd plenary meeting, on 20 September 1986, the General Assembly, on the recommendation of the General Committee, decided to include the item in its agenda and to allocate it to the First Committee.<\/p><\/div>\n

<\/p>\n

\n

3.\t<\/span>At its 2nd meeting, on 8 October, the First Committee decided to hold a general debate on the disarmament items allocated to it, followed by statements on specific disarmament agenda items and continuation of general debate, as necessary.  The deliberations on those items, namely items 46 to 65 and item 144, took place between the 3rd and the 32nd meetings, from 13 October to 4 November (see A\/C.1\/41\/PV.3-32).<\/p><\/div>\n

<\/p>\n

\n

4.\t<\/span>In connection with item 49, the First Committee had before it the following documents:<\/p><\/div>\n

<\/p>\n

\n\t\t\t\t(a)\t<\/span>Establishment of a nuclear-weapon-free zone in the region of the Middle East:  report of the Secretary-General (A\/41\/465 and Add.1);\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t(b)\t<\/span>Letter dated 5 May 1986 from the Permanent Representative of Morocco to the United Nations addressed to the Secretary-General, transmitting the texts of the final communiqué and of the resolutions adopted by the Sixteenth Islamic Conference of Foreign Ministers, held at Fez from 25 to 29 Rabi UL Thani, 1406H (6 to 10 January 1986) (A\/41\/326-S\/18049);\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t(c)\t<\/span>Letter dated 30 September 1986 from the Permanent Representative of Zimbabwe to the United Nations addressed to the Secretary-General, transmitting the final documents of the Eighth Conference of Heads of State or Government of Non-Aligned Countries, held at Harare, from 1 to 6 September 1986 (A\/41\/697-S\/18392);\n\t\t\t\t<\/div>\n

\n\t\t\t\t(d)\t<\/span>Note verbale dated 9 October 1986 from the Permanent Mission of Zimbabwe to the United Nations addressed to the Secretary-General, transmitting the final communiqué of the Meeting of Ministers and Heads of Delegation of the Non-Aligned Countries to the forty-first session of the General Assembly, held on 2 October 1986 in New York (A\/41\/703-S\/18395).\n\t\t\t\t<\/div>\n

II. CONSIDERATION OF DRAFT RESOLUTION A\/C.1\/41\/L.19<\/p><\/div>\n

\n

5.\t<\/span>On 29 October 1986, Egypt<\/u> submitted a draft resolution entitled "Establishment of a nuclear-weapon-free zone in the region of the Middle East" (A\/C.1\/41\/L.19), which was introduced by its representative at the 35th meeting, on 6 November.<\/p><\/div>\n

<\/p>\n

\n

6.\t<\/span>At its 39th meeting, on 11 November, the Committee adopted draft resolution A\/C.1\/41\/L.19 without a vote (see para. 7).<\/p><\/div>\n

\n

III.  RECOMMENDATION OF THE FIRST COMMITTEE<\/p><\/div>\n

<\/p>\n

\n

7.\t<\/span>The First Committee recommends to the General Assembly the adoption of the following draft resolution:<\/p><\/div>\n

\n

Establishment of a nuclear-weapon-free zone<\/u><\/p><\/div>\n

\n

in the region of the Middle East<\/u><\/p><\/div>\n

<\/p>\n

\n\t\t\t\tThe General Assembly<\/u>,\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\tRecalling<\/u> its resolutions 3263 (XXIX) of 9 December 1974, 3474 (XXX) of 11 December 1975, 31\/71 of 10 December 1976, 32\/82 of 12 December 1977, 33\/64 of 14 December 1978, 34\/77 of 11 December 1979, 35\/147 of 12 December 1980, 36\/87 of 9 December 1981, 37\/75 of 9 December 1982, 38\/64 of 15 December 1983, 39\/54 of 12 December 1984 and 40\/82 of 12 December 1985 on the establishment of a nuclear-weapon-tree zone in the region of the Middle East,\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\tRecalling also<\/u> the recommendations for the establishment of such a zone in the Middle East consistent with paragraphs 60 to 63, and in particular paragraph 63 (d), of the Final Document of the Tenth Special Session of the General Assembly,1<\/u>\/ the first special session devoted to disarmament,\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\tEmphasizing<\/u> the basic provisions of the above-mentioned resolutions, which call upon all parties directly concerned to consider taking the practical and urgent steps required for the implementation of the proposal to establish a nuclear-weapon-free zone in the region of the Middle East and, pending and during the establishment of such a zone, to declare solemnly that they will refrain, on a reciprocal basis, from producing, acquiring or in any other way possessing nuclear weapons and nuclear explosive devices and from permitting the stationing of nuclear weapons on their territory by any third party, to agree to place all their nuclear facilities under International Atomic Energy Agency safeguards and to declare their support for the establishment of the zone and deposit such declarations with the Security Council for consideration, as appropriate,\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\tReaffirming<\/u> the inalienable right of all States to acquire and develop nuclear energy for peaceful purposes,\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\tEmphasizing further<\/u> the need for appropriate measures on the question of the prohibition of military attacks on nuclear facilities,\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\tBearing in mind<\/u> the consensus reached by the General Assembly at its thirty-fifth session that the establishment of a nuclear-weapon-free zone in the region of the Middle East would greatly enhance international peace and security, 2<\/u>\/\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\tDesirous<\/u> to build on that consensus so that substantial progress can be made towards establishing a nuclear-weapon-free zone in the region of the Middle East,\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\tEmphasizing<\/u> the essential role of the United Nations in the establishment of a nuclear-weapon-free zone in the region of the Middle East,\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\tTaking note<\/u> of the report of the Secretary-General, 3<\/u>\/\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t1.\t<\/span>Urges<\/u> all parties directly concerned to consider seriously taking the practical and urgent steps required for the implementation of the proposal to establish a nuclear-weapon-free zone in the region of the Middle East in accordance with the relevant resolutions of the General Assembly and, as a means of promoting this objective, invites the countries concerned to adhere to the Treaty on the Non-Proliferation of Nuclear Weapons: 4<\/u>\/\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t2.\t<\/span>Calls upon<\/u> all countries of the region that have not done so, pending the establishment of the zone, to agree to place all their nuclear activities under International Atomic Energy Agency safeguards;\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t3.\t<\/span>Invites<\/u> those countries, pending the establishment of a nuclear-weapon-free zone in the region of the Middle East to declare their support for establishing such a zone, consistent with the relevant paragraph of the Final Document of the Tenth Special Session of the General Assembly, the first special session devoted to disarmament, and to deposit those declarations with the Security Council;\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t4.\t<\/span>Further invites<\/u> those countries, pending the establishment of the zone, not to develop, produce, test or otherwise acquire nuclear weapons or permit the stationing on their territories, or territories under their control, of nuclear weapons or nuclear explosive devices;\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t5.\t<\/span>Invites<\/u> the nuclear-weapon States and all other States to render their assistance in the establishment of the zone and at the same time to refrain from any action that runs counter to both the letter and spirit of the present resolution;\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t6.\t<\/span>Extends its thanks<\/u> to the Secretary-General for his report containing the views of parties concerned regarding the establishment of a nuclear-weapon-free zone in the region of the Middle East; 3<\/u>\/\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t7.\t<\/span>Takes note<\/u> of the above-mentioned report;\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t8.\t<\/span>Requests<\/u> those parties that have not yet communicated their views to the Secretary-General to do so;\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t9.\t<\/span>Welcomes<\/u> any further comments from those parties that have already communicated their views to the Secretary-General;\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t10.\t<\/span>Requests<\/u> the Secretary-General to submit a report to the General Assembly at its forty-second session on the implementation of the present resolution;\n\t\t\t\t<\/div>\n

<\/p>\n

\n\t\t\t\t11.\t<\/span>Decides<\/u> to include in the provisional agenda of its forty-second session the item "Establishment of a nuclear-weapon-free zone in the region of the Middle East".\n\t\t\t\t<\/div>\n
