PROGRESS REPORT OF THE UNITED NATIONS MEDIATOR ON PALESTINE<\/p><\/div>\n

Syria: Draft Resolution<\/u><\/p><\/div>\n

<\/p>\n

\n

\t<\/span>THE GENERAL ASSEMBLY,<\/p><\/div>\n

<\/p>\n

\n

\t<\/span>Noting<\/u> that certain delegations, while discussing the problem of Palestine, have raised objections as regards the legal aspect involved in this problem, and contended the power of the General Assembly under the Charter to partition Palestine for the creation of a Jewish sovereign State, against the wishes of the majority of the Palestine population;<\/p><\/div>\n

<\/p>\n

\n

\t<\/span>Noting<\/u> that contentions were also raised as to the international status of Palestine upon the termination of the Mandate on 15 May 1948;<\/p><\/div>\n

<\/p>\n

\n

\t<\/span>DECIDES to request the International Court of Justice, under Article 96 of the Charter and Charter IV of its Statute, to give a legal opinion on the points mentioned above;<\/p><\/div>\n

<\/p>\n

\n

\t<\/span>The Secretary-General will supply the Court with documents pertinent to this subject, and the parties, Arabs and Jews may submit to the Court through the Secretary-General, the representations which they deem useful and helpful to clarify the question.<\/p><\/div>\n
