Security Council Committee established pursuant to resolution 2127 (2013) concerning the Central African Republic

The Security Council Committee established pursuant to resolution 2127 (2013) Document PDF concerning the Central African Republic (hereafter “the Committee”), recently extended pursuant to resolution 2693 (2023), oversees the sanctions measures imposed by the Security Council.

Arms Embargo

Until 31 July 2024, Member States shall continue to take the necessary measures to prevent the direct or indirect supply, sale or transfer to the CAR, from or through their territories or by their nationals, or using their flag vessels or aircraft, of arms and related materiel of all types, including weapons and ammunition, military vehicles and equipment, paramilitary equipment, and spare parts for the aforementioned, and technical assistance, training, financial or other assistance, related to military activities or the provision, maintenance or use of any arms and related materiel, including the provision of armed mercenary personnel whether or not originating in their territories;

 

All Member States are authorized to, and all Member States shall, upon discovery of items prohibited seize, register and dispose (such as through destruction, rendering inoperable, storage or transferring to a State other than the originating or destination States for disposal) items the supply, sale, transfer or export of which is prohibited and decides further that all Member States shall cooperate in such efforts;

 

Renews until 31 July 2024 the measures and provisions as set out in paragraph 4 of resolution 2488 (2019), except for the supply, sale or transfer of arms and related materiel and the provision of assistance, advice and training to the CAR security forces, in paragraph 5 of resolution 2488 (2019) and in paragraph 2 of resolution 2399 (2018) and recalls paragraph 9 of resolution 2488 (2019);

Travel Ban

All Member States shall, through 31 July 2024 continue to take the necessary measures to prevent the entry into or transit through their territories of individuals designated by the Committee, provided that nothing in this paragraph shall oblige a State to refuse its own nationals entry into its territory, and calls upon the CAR Government to enhance cooperation and information sharing with other States in this regard

Asset Freeze

All Member States shall, through 31 July 2024, continue to freeze without delay all funds, other financial assets and economic resources which are on their territories, which are owned or controlled, directly or indirectly, by the individuals or entities designated by the Committee, or by individuals or entities acting on their behalf or at their direction, or by entities owned or controlled by them, and decides further that all Member States shall continue to ensure that any funds, financial assets or economic resources are prevented from being made available by their nationals or by any individuals or entities within their territories, to or for the benefit of the individuals or entities designated by the Committee.

Work and mandate of the Committee

The Committee comprises all 15 members of the Security Council and makes its decision by consensus. The current Chair of the Committee, for the period ending 31 December 2024, is H.E. Mr. Amar Bendjama (Algeria). The Vice-Chair for 2024 is Guyana. The Committee prepares annual reports of its activities. The Committee has Guidelines for the conduct of its work. Formal and informal meetings of the Committee are announced in the Journal of the United Nations. The work of the Committee is supported by the Panel of Experts whose tasks are set out in paragraph 32 of resolution 2399 (2018), and whose mandate was extended by paragraph 6 of resolution 2693 (2023).

The Committee is mandated to:

  • monitor implementation of the measures imposed in paragraphs 54 and 55 of resolution 2127 (2013), and paragraphs 30 and 32 of resolution 2134 (2014), as extended by paragraph 24 of resolution 2399 (2018) with a view to strengthening, facilitating and improving implementation of these measures by Member States;
  • review information regarding those individuals and entities who/which may be engaging in the acts described in paragraphs 20 and 21 of resolution 2399 (2018);
  • report to the Security Council on its work and thereafter to report as deemed necessary by the Committee;
  • encourage a dialogue between the Committee and interested Member States, in particular those in the region, including by inviting representatives of such States to meet with the Committee to discuss implementation of the measures;
  • seek from all States whatever information it may consider useful regarding the actions taken by them to implement effectively the measures.

Background information

The Security Council Committee established pursuant to resolution 2127 (2013) Document PDF concerning the Central African Republic (CAR) was created on 5 December 2013 to oversee the relevant sanctions measure (arms embargo) and to undertake the tasks set out by the Security Council in paragraph 57 of the same resolution. By paragraphs 30 and 32 of resolution 2134 (2014) Document PDF, respectively, the Security Council further imposed a travel ban and an asset freeze.

In its resolution 2693 (2023), the Council decided that the mandate of the Committee shall apply to the measures extended through 31 July 2024 in the same resolution.

Arms Embargo

The Security Council first imposed a general and complete arms embargo on the Central African Republic on 5 December 2013 with the adoption of resolution 2127 (2013).By paragraph 1 of resolution 2693 (2023), the Council decided that the arms embargo measures established by resolution 2127 (2013) and the notification requirements set out in paragraph 1 of resolution 2648 (2022) shall no longer apply to the supply, sale or transfer of arms and related materiel and the provision of assistance, advice and training to the CAR security forces, including state civilian law enforcement institutions.

Targeted Sanctions

By resolution 2127 (2013) and resolution 2134 (2014) Document PDF, the Security Council decided to impose individual targeted sanctions (an arms embargo, including training and financial assistance, on individuals and entities; a travel ban on individuals; and an assets freeze on individuals and entities, as designated by the Committee). The Security Council decided to extend the targeted sanctions by resolution 2536 (2020). Paragraphs 1(a-i) of resolution 2648 (2022) and paragraphs 14, 17,18 and 19 of resolution 2399 (2018) contain exemptions to those measures as amended and/or renewed by paragraphs 1, 2 and 3 of resolution 2693 (2023).

Under the sanctions regime, the Committee is mandated to consider designating individuals or entities on the basis of the criteria contained in paragraphs 20 and 21 of resolution 2399 (2018) as extended by paragraph 5 of resolution 2507 (2020) and reaffirmed by paragraph 5 of resolution 2693 (2023).
