of Individuals and Entities Subject to Travel Ban, Assets Freeze

 


On 8 July 2011, the Security Council Committee established pursuant to resolution 1533 (2004) concerning the Democratic Republic of the Congo approved updates to the List of individuals and entities subject to the travel ban and assets freeze imposed by paragraphs 13 and 15 of resolution 1596 (2005), as renewed by paragraph 3 of resolution 1896 (2009) and paragraph 3 of resolution 1952 (2010).


The List has been updated as follows:


For Frank Kakolele BWAMBALE, under the field “Passport/Identifying Information”, was added “Congolese”, “FARDC General, without posting as of June 2011”. Was deleted “December 2008”, and was added “June 2011”. And was added: “Since 2010, Kakolele has been involved in activities apparently on behalf of the DRC government’s Programme de Stabilisation et Reconstruction des Zones Sortant des Conflits Armés (STAREC), including participation in a STAREC mission to Goma and Beni in March 2011”.


For Gaston IYAMUREMYE, under the field “Passport/Identifying Information”, was deleted: “Second Vice President of FDLR” and “As of November 2010, resides either in Kibua, North Kivu, DRC, or in Aru, Orientale Province, DRC”, and was added: “Rwandan”, “FDLR President and 2nd Vice-President of FDLR-FOCA”and“As of June 2011, based at Kalonge, North Kivu Province.”


For Jérôme KAKWAVU BUKANDE, “Commandant Jérôme” was moved from the field “Passport/Identifying Information” to the field “Alias”. The phrase “Given the rank of General in the FARDC in December 2004” was moved from the field “Designation/Justification” to the field “Passport/Identifying Information”. Under the field “Passport/Identifying Information”, was deleted: “As of June 2010, has been arrested and is now being held in Kinshasa central prison. Judicial proceedings have been initiated against him and two other of the five senior FARDC officers”, and was added: “As of June 2011, detained in Makala Prison in Kinshasa. On 25 March 2011, the High Military Court in Kinshasa opened a trial against Kakwavu for war crimes”. Under the field “Designation/Justification”, “exercises”was replaced by“exercised”;“maintains” was deleted; and “have been”was replaced by“were”.


For Germain KATANGA, the phrase “Appointed General in the FARDC in December 2004” was moved from the field “Designation/Justification” to the field “Passport/Identifying Information”. Under the field “Passport/Identifying Information”, was deleted “Under house arrest in Kinshasa from March 2005 for FRPI involvement in human rights abuses”, and was added: “His trial began in November 2009”.


For Thomas LUBANGA, under the field “Passport/Identifying Information”, was deleted: “Congolese”, and “As of December 2008 is being tried for war crimes”.  And was added: “DRC” and “His trial began in January 2009 and is due to close in 2011”.


For Khawa Panga MANDRO, the phrase “Known as: “Chief Kahwa”, “Kawa” was moved from the field “Passport/Identifying Information” to the field “Alias”. The phrase “In prison in Bunia since 04/05 for sabotage of the Ituri peace process” was moved from the field “Designation/Justification” to the field “Passport/Identifying Information”, and was replaced by: “Placed in prison in Bunia in April 2005 for sabotage of the Ituri peace process”. Under the field “Passport/Identifying Information”, was added: “As of June 2011 detained at Makala Central Prison, Kinshasa”.


For Callixte MBARUSHIMANA, under the field “Passport/Identifying Information” was deleted “Current location: Paris or Thaïs, France.” And was added: “Arrested in Paris on 3 October 2010 under ICC warrant for war crimes and crimes against humanity committed by FDLR troops in the Kivus in 2009 and transferred to The Hague on 25 January 2011”. Under the field “Designation/Justification”, “until his arrest” was added at the end of the phrase “Executive Secretary of the FDLR and Vice-President of the FDLR military high command”.


For Iruta Douglas MPAMO, under the field “Passport/Identifying Information”, was deleted: “Based in Goma and Gisenyi, Rwanda. Frequently travels across international border between Rwanda and Congo” and “Address: Bld Kanyamuhanga, 52, Goma”.  And was added: “As of June 2011, resides in Gisenyi, Rwanda. No known occupation since two of the planes managed by Great Lakes Business Company (GLBC) crashed.” Under the field “Date of Birth/Place of Birth”, was added “Uvira”.


For Sylvestre MUDACUMURA, the phrase: “Known as: “Radja”, “Mupenzi Bernard”, “General Major Mupenzi”, “General Mudacumura” was moved from the field “Passport/Identifying Information” to the field “Alias”. Under the field “Passport/Identifying Information”, was deleted:“As of November 2009, continues to serve as FDLR-FOCA military commander. Based in Kibua, Masisi territory, DRC.” And was added: “Military commander of FDLR-FOCA, also political 1st Vice-President and head of FOCA High Command, thus combining overall military and political command functions since the arrests of FDLR leaders in Europe.  As of June 2011, based at Kikoma forest, near Bogoyi, Walikale, North Kivu.”


For Leodomir MUGARAGU, under the field “Passport/Identifying Information”, was deleted: “Address: Katoyi, North Kivu, DRC”, “FDLR/FOCA Chief of Staff”, and“Brigadier General”. And was added: “FDLR-FOCA Chief of Staff, in charge of administration. As of June 2011, based at the FDLR HQ at Kikoma forest, Bogoyi, Walikale, North Kivu”.


For Leopold MUJYAMBERE, under the field “Passport/Identifying Information”, was deleted: “Rank: Colonel”, “Current location: Mwenga, South Kivu, DRC”. And was added: “As of June 2011, Commander of the South Kivu operational sector now called ‘Amazon’ of FDLR-FOCA”and “Based at Nyakaleke (south-east of Mwenga, South Kivu)”.


For Ignace MURWANASHYAKA, under the field “Passport/Identifying Information”, was deleted: “Resident in Germany”and “As of November 2009, still recognized as the President of the FDLR-FOCA political branch and supreme commander of the FDLR armed forces” and “Arrested by German Federal Police on 17 November 2009 on suspicion of committing crimes against humanity and war crimes in the DRC, as well as on the basis of other charges related to the forming and membership of a foreign terrorist organization”. And was added “Arrested by German authorities on 17 November 2009. Replaced by Gaston Iamuremye, alias ‘Rumuli’ as President of FDLR-FOCA. Murwanashyaka’s trial for war crimes and crimes against humanity committed by FDLR troops in DRC in 2008 and 2009 began on 4 May 2011 in a German court.” Under the field “Designation/Justification”, was deleted: “Traveled to Uganda in 2006 in violation of travel ban”. 


For Straton Musoni, under the field “Passport/Identifying Information”, was deleted: “Rwandan passport expired on 10 September 2004”and“Resident in Neuffen, Germany” and “As of November 2009, still recognized as the 1st Vice President of the FDLR-FOCA political branch and President of the FDLR military high command”and “Arrested by German Federal Police on 17 November 2009 on suspicion of committing crimes against humanity and war crimes in the DRC, as well as on the basis of other charges related to the forming and membership of a foreign terrorist organization”.  And was added: “Rwandan”and “Arrested by German authorities on 17 November 2009” and “Musoni’s trial for war crimes and crimes against humanity committed by FDLR troops in DRC in 2008 and 2009 began on 4 May 2011 in a German court”and “Replaced as 1st Vice-President of the FDLR by Sylvestre Mudacumura”.


For Jules MUTEBUTSI, under the field “Date of Birth/Place of Birth”, “South Kivu” was replaced by “1964, Minembwe South Kivu”. Under the field “Passport/Identifying Information”, “(South Kivu)” was deleted. The phrase “Former FARDC Deputy Military Regional Commander of 10th Military Region in April 2004, dismissed for indiscipline” was moved from the field “Designation/Justification” to the field “Passport/Identifying Information”. Under the field “Passport/Identifying Information”, was deleted: “Arrested by the Rwandan authorities in December 2007 when he tried to cross the border into the DRC. Reportedly he is currently “restrained.”And was added: “In December 2007, he was arrested by Rwandan authorities when he tried to cross the border into the DRC.  He has lived since in semi-liberty in Kigali (not authorized to leave the country).”


For Mathieu Chui NGUDJOLO, under the field “Passport/Identifying Information”, was deleted: “‘Colonel’ or ‘General’”. The phrase “Arrested by MONUC in Bunia in October 2003” was moved from the field “Designation/Justification” to the field “Passport/Identifying Information”.


For Floribert Ngabu NJABU, under the field “Passport/Identifying Information”, was deleted: “Arrested and placed under house arrest in Kinshasa from March 2005 for FNI involvement in human rights abuses.” And was added: “Under house arrest in Kinshasa since March 2005 for FNI involvement in human rights abuses.”and “Transferred to The Hague on 27 March 2011 to testify in the ICC Germain Katanga and Mathieu Ngudjolo trials.”


For Laurent Nkunda, “Chairman”,“General Nkunda”, and“Papa Six” were moved from the field “Passport/Identifying Information” to the “Alias” field. The phrase “Founder, National Congress for the People’s Defense, 2006; Senior Officer, Rally for Congolese Democracy-Goma (RCD-G), 1998-2006; Officer Rwandan Patriotic Front (RPF), 1992-1998” was moved from the field “Designation/Justification” to the field “Passport/Identifying Information”. The phrase “As of November 2009, despite arrest in Rwanda in January 2009 and removal as President of CNDP, retains some control over CNDP” was also moved from the field “Designation/Justification” to the field “Passport/Identifying Information”, and updated. Under the field “Passport/Identifying Information”, was deleted: “Arrested on Rwandan soil in January 2009 and subsequently replaced as commander of the CNDP in North Kivu”. As a result, the field “Passport/Identifying Information” currently reads as follows: “Former RCD-G General. Founder, National Congress for the People’s Defense, 2006; Senior Officer, Rally for Congolese Democracy-Goma (RCD-G), 1998-2006; Officer Rwandan Patriotic Front (RPF), 1992-1998. Laurent Nkunda was arrested by Rwandan authorities in Rwanda in January 2009 and replaced as the commander of the CNDP. Since then, he has been under house arrest in Kigali, Rwanda. DRC Government’s request to extradite Nkunda for crimes committed in eastern DRC has been refused by Rwanda. In 2010, Nkunda’s appeal for illegal detention was rejected by Rwandan court in Gisenyi, ruling that the matter should be examined by a military court. Nkunda’s lawyers initiated a procedure with the Rwandan Military Court. Retains some influence over certain elements of the CNDP”.


For Felicien NSANZUBUKIRE, under the field “Designation/Justification” was deleted “According to multiple sources, Felicien Nsanzubukire is the 1st battalion leader of the FDLR, and is based in the Uvira-Sange area of South Kivu”, and“Felicien Nsanzubukire has been a member of the FDLR since at least 1994 and operating in eastern DRC since October 1998”. Was also deleted “The UNSC DRC Sanction Committee’s Group of Experts reports that”.  Under the field “Passport/Identifying Information” was added  “Rwandan”and“1st battalion leader of the FDLR-FOCA, based in the Uvira-Sange area of South Kivu”. Was also added“A member of the FDLR since at least 1994 and operating in eastern DRC since October 1998”and“As of June 2011, based in Magunda, Mwenga territory, South Kivu”.


For Pacifique NTAWUNGUKA, under the field “Passport/Identifying Information” was deleted: “Rank: Colonel”and“Current Location: Peti, Walikale - Masisi border, DRC” and “Other”. Was added: “Commander, Operational Sector North Kivu ‘SONOKI’ of FDLR-FOCA”and“As of June 2011, based at Matembe, North Kivu”. Under the field “Designation/Justification”, “branch” was replaced by “wing”.


For James NYAKUNI, under the field “Designation/Justification”, “Commandant Jérôme” was replaced by “Jérôme Kakwavu”.


For Stanislas NZEYIMANA, under the field “Passport/Identifying Information” was deleted: “As of November 2009, recognized as Major General Stanislas Nzeyimana, FDLR Deputy Commander. Current location: Kalonge, Masisi, North Kivu, DRC or Kibua, DRC. Frequent travel to Kigoma.” And was added: “Deputy commander of the FDLR-FOCA. As of June 2011, based at Mukoberwa, North Kivu.”


For Dieudonné OZIA MAZIO, the phrase “Known as: ‘Omari’, ‘Mr Omari’” was moved from the field “Passport/Identifying Information” to the “Alias” field.  Under the field “Passport/Identifying Information”, was added “President of FEC in Aru territory”and“Believed to have” (deceased in Ariwara on 23 September 2008)”.


For Bosco TAGANDA, under the field “Alias” was added: “‘Lydia’ when he was part of APR”and“Terminator”and “Tango” and “Call sign ‘Tango Romeo’ or ‘Tango’” and “Major”. Under the field “Passport/Identifying Information”, was deleted: “Known as: ‘Terminator’, ‘Major’”. Under the field “Date of Birth/Place of Birth”, was added: “1973-74, Bigogwe, Rwanda”.  Under the field “Passport/Identifying Information”, was deleted: “As of November 2009, de facto military head of CNDP following arrest of General Laurent Nkunda in January 2009. Former chief of staff of the CNDP. Based in Bunagana and Rutshuru”and“Since appointment as the de facto military head of CNDP in January 2009, has been instructed to manage integration into FARDC and given the post of deputy operational commander for Kimia II although this is officially denied by FARDC”. And was added: “Congolese”and“Born in Rwanda, he moved to Nyamitaba, Masisi territory, North Kivu, when he was a child”and“As of June 2011, he resides in Goma and owns large farms in Ngungu area, Masisi territory, North Kivu.”and“Nominated FARDC Brigadier-General by Presidential Decree on 11 December 2004, following Ituri peace agreements.”and “Formerly Chief of Staff in CNDP and became CNDP military commander since the arrest of Laurent Nkunda in January 2009”and“Since January 2009, de facto Deputy Commander of consecutive anti-FDLR operations ‘Umoja Wetu’, ‘Kimia II’, and ‘Amani Leo’ in North and South Kivu.”


For Innocent Zimurinda, “Zimulinda” was added to the “Alias” field. Under the field “Passport/Identifying Information”, was deleted: “According to open-source and official reporting, Lt Col Innocent Zimurinda was an officer in the Congrès National pour la Défense du Peuple (CNDP) which was integrated into Forces Armées de la République Démocratique du Congo (FARDC) in early 2009”. And was added: “Congolese”and“Colonel in the FARDC”and“Integrated in the FARDC in 2009 as a Lieutenant Colonel, brigade commander in FARDC Kimia II Ops, based in Ngungu area”. Was also added:“In July 2009, Zimurinda was promoted to full Colonel and became FARDC Sector commander in Ngungu and subsequently in Kitchanga in FARDC Kimia II and Amani Leo Operations.”and“Whereas Zimurinda did not appear in the 31 December 2010 DRC Presidential ordinance nominating high FARDC officers, Zimurinda de facto maintained his command position of FARDC 22nd sector in Kitchanga and wears the newly issued FARDC rank and uniform.”Was also added:“He remains loyal to Bosco Ntaganda.”and “In December 2010, recruitment activities carried out by elements under the command of Zimurinda were denounced in open source reports.” Under the field “Designation/Justification”, the phrase: “posted a complaint online alleging” was replaced by “alleged”;“Lt Col Innocent”was deleted;the phrase“has also been”was replaced by“was”; the phrase“to be responsible”was replaced by“of responsibility”. 


For BUTEMBO AIRLINES (BAL), under the field “Passport/identifying information”, “As of” was replaced by “Since”.


Under the field “Last Name”, “CONGOCOM TRADING HOUSE” was deleted, and replaced by: “Congomet Trading House”. Under the field “Date of Birth/Place of Birth”, was deleted: “Butembo, DRC, Tel: +253 (0) 99 983 784”; and was added: “Butembo, North Kivu”. Under the field “Passport/Identifying information”, was deleted: “Gold trading house in Butembo”. And was added: “No longer exists as a gold trading house in Butembo, North Kivu”. Under the field “Designation/Justification”, was deleted: “CONGOCOM”, and was added: “Congomet Trading House (formerly listed as Congocom)”; “is” was replaced by “was”; and “derive” replaced by “derived”.


For MACHANGA LTD, under the field “Passport/Identifying information” was deleted “in Kampala” and was added: “In 2010, assets belonging to Machanga, held in the account of Emirates Gold, were frozen by Bank of Nova Scotia Mocatta (UK)”and“The previous owner of Machanga, Rajendra Kumar, and his brother Vipul Kumar, have remained involved in purchasing gold from eastern DRC.”


For TOUS POUR LA PAIX ET LE DEVELOPPEMENT (NGO), under the field “Passport/Identifying information” was added: “Goma, with provincial committees in South Kivu, Kasai Occidental, Kasai Oriental and Maniema”. For UGANDA COMMERCIAL IMPEX (UCI) LTD, under the field “Passport/Identifying information”, was deleted: “Directors”, and was added: “Former directors”. Was also deleted “in Kampala”, and was added: “In January 2011, Ugandan authorities notified the Committee that following an exemption on its financial holdings, Emirates Gold repaid UCI’s debt to Crane Bank in Kampala, leading to final closure of its accounts”and“The previous owner of UCI, J.V. Lodhia and his son Kumal Lodhia have remained involved in purchasing gold from eastern DRC.”
