| Technical Assistance Programme Description | Institution-Building and Rule of Law The Council of Europe (CoE) has adopted numerous international standards (both binding -international treaties- and non-binding -recommendations, principles and rules-) in the field of justice and the rule of law, including the European Convention on Human Rights (ECHR) and the judgments of the European Court of Human Rights on individual complaints relating to justice and the rule of law. The main feature of the CoE's approach is its integrated character. The above-mentioned standards compliment other standards on international co-operation (extradition, mutual legal assistance, transfer of legal proceedings, transfer of sentenced persons, etc), substantive criminal law (terrorism, cybercrime, corruption, etc) and in other fields, such as the protection of victims. It is common for the same instrument to integrate different aspects, e.g. terrorism instruments contain human rights safeguards and conditions. CoE target co-operation programmes concerning justice and the rule of law are designed to assist European states (including those wishing to join the European Union). Their specific objectives are: - to improve the respect and effective implementation of legal standards in Europe and the functioning, according to these principles, of states' structures and administrative, jurisdictional and law-enforcement institutions at all levels; and - to assist member states (and applicant states) to fulfil their commitments in the human rights field, in particular as regards the compatibility of their legislation and practices with the ECHR and other Council of Europe human rights standards, and to develop and implements initiatives and actions for, and with, civil society. Such co-operation is provided primarily on the basis of the above-mentioned standards, which include numerous recommendations by the CoE Committee of Ministers to the governments of member states dealing with matters such as legal aid and advice, access to justice for the very poor, measures facilitating access to justice, mediation, principles of civil procedure to improve the functioning of justice, measures to prevent and reduce the excessive workload of courts, simplification of criminal justice, functioning of appeal systems and procedures in civil and commercial cases, management of criminal justice, and the use of new technologies. |

| Technical Assistance Methodology | CoE assistance activities facilitate the fulfilment of commitments by member and applicant states, including in the framework of joint initiatives with the European Commission and other partners. In that respect, the Council of Europe: - develops interaction and synergies between the work of the Council of Europe in the field of human rights law and policy and other European, regional and universal actors in the field of human rights through targeted contacts and liaison with the competent services and bodies of the United Nations, the OSCE and the European Union; - works with and through non-governmental organisations and relevant professional groups on targeted human rights issues; and - liaises with Council of Europe field offices and information offices within its field of competence. |
