2 [Status Conference]
3 [Open session]
4 [The appellants entered court]
5 --- Upon commencing at 2.21 p.m.
6 JUDGE SHAHABUDDEEN: Ms. Registrar, would you please call the
7 case.
8 THE REGISTRAR: Your Honour, this is case number IT-02-60-A, the
9 Prosecutor versus Vidoje Blagojevic and Dragan Jokic.
10 JUDGE SHAHABUDDEEN: Good afternoon to you all. This is a Status
11 Conference in the case of the Prosecution against Blagojevic and Jokic. I
12 would like to begin by ensuring in the usual way that the audio equipment
13 is functioning properly.
14 Mr. Jokic and Mr. Blagojevic, can each of you hear the proceedings
15 in a language you understand?
16 THE APPELLANT JOKIC: [Interpretation] Your Honour, I can hear you
17 and I can understand you fully.
18 THE APPELLANT BLAGOJEVIC: [Interpretation] Your Honour, I can hear
19 and I can understand.
20 JUDGE SHAHABUDDEEN: What about each counsel? Mr. Domazet.
21 MR. DOMAZET: Yes, Your Honour, Vladimir Domazet. I'm counsel for
22 Vidoje Blagojevic.
23 JUDGE SHAHABUDDEEN: Yes.
24 MS. LINDSAY: Good morning -- good afternoon, Your Honour.
25 Virginia Lindsay. I'm standing in for Professor Peter Murphy on behalf of
Page 246
1 Mr. Dragan Jokic.
2 JUDGE SHAHABUDDEEN: I shall have something to say on that point
3 immediately.
4 Let me hear from the Prosecution.
5 MS. KIND: Good afternoon, Your Honour. My name is Marie-Ursula
6 Kind for the Prosecution, together with senior counsel, Mr. Norman Farrell
7 and our case manager, Ms. Lourdes Galicia, and we can hear you well.
8 Thank you.
9 JUDGE SHAHABUDDEEN: What I wanted to say is that Mr. Murphy, the
10 lead counsel for Mr. Jokic, had to be away from The Hague today on an
11 urgent personal matter. As co-counsel for Mr. Jokic is also out of the
12 country, Mr. Murphy requested that Mr. Jokic be represented at this Status
13 Conference by Ms. Virginia Lindsay, a legal consultant for Mr. Jokic.
14 I agreed to Mr. Murphy's request. Ms. Lindsay is a member of the
15 Association of Defence Counsel of the ICTY, and she's on the Rule 45 list
16 of Defence counsel. She has represented a number of accused before this
17 Tribunal and is I believe here with us today. I wish to welcome you, Ms.
18 Lindsay.
19 Now I would like to call for the appearances, if I may. There
20 will be Mr. Blagojevic will be represented by Mr. Domazet. Is that right?
21 Mr. Jokic will be represented by Ms. Lindsay. Is that right?
22 MS. LINDSAY: Yes, Your Honour.
23 JUDGE SHAHABUDDEEN: And Prosecution will be represented by
24 Mr. Norman Farrell and Marie-Ursula Kind, with Ms. Kind making the
25 submissions I hope. Yes. Thank you.

1 Now, as you're aware, Rule 65 bis of the Rules of Procedure and
2 Evidence requires that Status Conferences be held for each appellant in
3 the Tribunal's custody at intervals no greater than 120 days. The last
4 Status Conference in this case was held jointly for Mr. Blagojevic on 23
5 August 2006. A further Status Conference was planned for 4th December
6 2006 but was cancelled in view of the appeals hearing in this case on the
7 5th and 6th of December, 2006.
8 As you know, the purposes of Status Conferences are two-fold.
9 First, to allow the appellants to express concerns relating to the appeal
10 and detention conditions; and, secondly, to update the appellants with
11 respect to the status of each case.
12 Now, I shall begin with the second of these objectives by
13 remarking something which you know well, that the Appeals Chamber's
14 hearing of this appeal was on the 5th and 6th December, 2004 [sic].
15 Judgement will be delivered in due course.
16 There are no pending motions in this case. Would any of the
17 parties like to raise any matter in respect of the status of the appeals?
18 If not, then I would like to ask whether the appellants themselves have
19 any questions or concerns that they would like to raise relating to the
20 conditions of their detention and any other relevant matters.
21 Over to you, Mr. Blagojevic and Mr. Jokic.
22 THE APPELLANT BLAGOJEVIC: [Interpretation] Your Honour, as regards
23 the conditions in the Detention Unit, I have nothing particular to say.
24 I'm receiving medical therapy for my condition; and as for the rest, there
25 is nothing that should be mentioned that has changed from the last Status
Page 248
1 Conference as regards my conditions of detention.
2 JUDGE SHAHABUDDEEN: Thank you, sir. May I hear from your
3 colleague.
4 THE APPELLANT JOKIC: [Interpretation] Your Honour, I have no
5 remarks at this point.
6 JUDGE SHAHABUDDEEN: Well, then if there are no further matters to
7 be discussed, we might take the adjournment now. Thank you.
8 --- Whereupon the Status Conference
9 adjourned at 2.29 p.m.
