Momir
Talic Granted Provisional Release
Today,
Friday 20 September 2002, Trial Chamber II of the International Criminal Tribunal
for the former Yugoslavia, comprised of Judge Agius, presiding, Judge Janu and
Judge Taya, granted the Motion by the Defence of Momir Talic for provisional
release.
The
Trial Chamber deemed it ‘appropriate’ to order the provisional release of Mr.
Talic in light of his medical condition. The ruling followed a confidential
Motion for provisional release filed on 10 September 2002, by the Defence of
Momir Talic and a confidential response to the Motion filed by the Office of
the Prosecutor on 17 September 2002. The confidentiality Order was lifted in
a hearing on Tuesday 17 September 2002 and an amendment to Mr. Talic’s Motion
for provisional release was filed publicly on 18 September 2002. The Trial Chamber
heard the parties and a representative of the Government of the Federal Republic
of Yugoslavia at a hearing on Thursday, 19 September 2002.
The
Decision sets out a number of terms and conditions to be complied with by Momir
Talic while on provisional release. Arrangements are being made for his transfer.
