STATEMENT BY THE PROSECUTOR

REGARDING THE DETENTION OF RADISLAV KRSTIC

 

The Prosecutor is in a position to confirm that on 2 December 1998, SFOR troops in the US Sector in Bosnia and Herzegovina, detained Radislav Krstic who had been indicted by the Prosecutor on 30 October 1998.

The indictment alleges that the accused, General-Major Krstic, as the Commander of the Drina Corps of the Bosnian Serb Army, committed Genocide during and after the fall of the UN safe area of Srebrenica between 11 July 1995 and 1 November 1995. Having regard to the gravity of the charges and the position of the accused, the Prosecutor considers this indictment to be important and the detention of the accused by SFOR to be very significant for the continuing work of the Tribunal.

The accused is also charged with five other counts in the indictment, all relating to the events which surround the fall of Srebrenica, namely Complicity to Commit Genocide; Extermination, a Crime Against Humanity; Murder, a Crime Against Humanity and a Violation of the laws or customs of war; and Persecutions, a Crime Against Humanity. The accused is charged in respect of his direct personal involvement in the commission of these crimes and also as being responsible as a commander for the actions of those under his authority.

The indictment was confirmed by Judge Florence Mumba on 2 November 1998, who also ordered that there be no public disclosure of the indictment or arrest warrant until the warrant had been served on the accused.

Arrangements are currently being made to transfer the accused to the seat of the Tribunal. Thereafter arrangements will be made for the accused’s initial appearance before a Trial Chamber.

The Prosecutor wishes to express her appreciation to SFOR troops and their commanders for their professionalism and for the support they are giving to the fulfilment of the mandate of the Tribunal.
