INDICTMENT
AMENDED, ACCUSED FACES ADDITIONAL CHARGES
As a result of
amendments to the indictment previously issued against him, Mr. Dusko TADIC
will appear on Tuesday 24 October 1995 to hear the additional charges
brought against him by the Prosecutor.
During this hearing,
scheduled at 10 a.m., the Accused will be called upon to enter a plea of guilty
or not guilty on each of the new counts.
New counts
Previously charged
with crimes allegedly committed between 24 May and 30 August 1992 at the Omarska
camp and in the areas of Kozarac, Jaskici and Sivci, the Accused is now additionally
charged with alleged crimes committed "between about 23 May and about
31 December 1992 at the Omarska, Keraterm and Trnopolje camps", and
"deportation" of Muslim and Croat residents of the Prijedor
area (north-western Bosnia).
The Prosecutor subsequently charges the accused with crimes against humanity
(persecution on political, racial and/or religious grounds and deportation)
and with a grave breach of the Geneva Conventions of 1949 (unlawful deportation,
or transfer or unlawful confinement of civilians).
All the previous
counts in the initial indictment remain in substance unchanged, although their
presentation has been modified. They were, and are:
- - Forcible
sexual intercourse with "F" (counts 4-6)
- - Killing of
four identified detainees, beating of one identified detainee, and inhumane
acts against "G" and "H" in Omarska (counts 7-13)
- - Beating of
one detainee in Omarska (counts 14-16)
- - Beating of
three identified detainees and other unnamed prisoners in Omarska (counts
17-19)
- - Abuse of
unknown prisoners in Omarska (counts 20-22)
- - Beating and
abuse of one identified detainee and other unnamed prisoners in Omarska (counts
23-25)
- - Killing of
four civilians in Kozarac (counts 26-30)
- - Killing of
five civilians and beating of eight civilians in the area of Jaskici and Sivci
The charges brought
in the initial indictment against co-accused Goran BOROVNICA remain unchanged.
New Preliminary
Motions filed by the Defence
Filed with the
Registry on 8 August 1995, the amended indictment has been reviewed by Judge
Adolphus Karibi-Whyte who considered the supporting material and who confirmed
it on 1 September 1995.
It was expeditiously
transmitted to the Defence lawyer who subsequently modified the motions previously
filed on the following issues:
- - Form of the
indictment
- - Principle
of non-bis-in-idem
- - Suppression
of evidence obtained in Germany from the accused
The amended Defence
motions filed on 4 September 1995 complain that the amended indictment is "even
more vague than the initial indictment " , "still unreasonably contains
a concurrence of crimes for the same behaviour", and "exposes
the accused to a double prosecution in the case of Keraterm". The third
motion (suppression of evidence obtained from the accused in Germany) has not
been modified.
The
above-mentioned Defence motions will be heard on Tuesday 24 October1995
immediately after the Initial Appearance Hearing on the amended indictment.
