Tribunal
President Judge Fausto Pocar issued an order on 14 March
2006 assigning Trial Chamber I to consider the question of varying
or lifting the protective measures applied to certain materials
in the case against Slobodan Milosevic.
The order
states that there are certain confidential materials in this
case that the Dutch authorities may require in completing their
inquest, and that Tribunal Vice-President Judge Kevin Parker
may require in completing the Tribunal’s separate internal
inquiry.
Following Slobodan
Milosevic’s death in the UN
Detention Unit on Saturday 11 March 2006, Dutch authorities began
an investigation under Dutch law that is independent of the Tribunal.
In addition, under his authority under the Tribunal’s Statute
and Rules, Judge Fausto Pocar ordered an internal inquiry. He
appointed Tribunal Vice-President Judge Kevin Parker to head
it.
In his order,
President Pocar noted that it is in the interests of the Tribunal
and the public that Dutch authorities and Judge Kevin Parker
have at their disposal all
of the relevant documents required for a thorough investigation
into Slobodan Milosevic’s death.
The Tribunal
indicted Slobodan Milosevic with numerous crimes
committed in Kosovo, Croatia and Bosnia and Herzegovina from
1991 to 1999. He stood trial for
these crimes from February 2002 until his death on Saturday.
Trial Chamber III formally closed the proceedings against him
yesterday.
