Press Briefing REGISTRY AND
CHAMBERS Good afternoon, The President of the Tribunal, Judge Theodor Meron, met the British Foreign Secretary, Jack Straw, and other senior officials in London on Monday, 10 November 2003. The discussions that they had were useful and constructive. The Tribunal is pleased to be receiving a visit from the Australian Foreign Minister, Alexander Downer, tomorrow. Among others, Foreign Minister Downer will meet with President Meron. On Friday, the Tribunal will be hosting another diplomatic seminar. Representatives from the various embassies here in The Hague have been invited to the ICTY to hear an update about the work of the court and its plans for the future including the completion strategy. On behalf of the Tribunal’s Outreach Programme: The Outreach Programme has launched the new Bosnian/Croatian/Serbian (BCS) section of the ICTY Website. This section of the Website is dedicated to the communities from the former Yugoslavia and has been redesigned and restructured to better serve the needs of its users. In addition to general information about the ICTY, the site provides access to all Tribunal documents electronically available in BCS. This information is updated on a daily basis. The redesigned web page will now allow for quicker and more efficient access to information about all new developments at the Tribunal. The main advantage of the new version of the BCS section of the ICTY website is that all available information about a particular case or accused, for example, can now be found in one place. Outreach has also hosted a number of visits to the ICTY. Next week Outreach will be hosting a week long visit for eight Judges and Prosecutors from the Brcko district in Bosnia and Herzegovina. A comprehensive programme has been organised for them including a roundtable with ICTY Judges, briefings from Senior Legal Officers in Chambers and Senior Trial Attorneys from OTP, attendance at court sessions, as well as visits to the ICC and ICJ. This visit is supported by the Brcko Legal Reform Office of the OHR. Yesterday, Outreach hosted a brief visit of 45 Judges and future Judges from Serbia and Montenegro. The visit was supported by the Judicial Law Centre of Serbia and Montenegro and it was part of a week long visit to European Judicial Institutes. Finally, a municipal delegation from Srebrenica has just completed a short visit to the ICTY at the initiative of the Dutch NGO "Interchurch Peace Council" (IKV). With the assistance of the Outreach Programme, the Srebrenica delegation (who is in The Netherlands for a week long tour including visits to several Dutch municipalities) attended the Milosevic trial and was briefed on ICTY related items. In terms of other court documents: On 6 November in the Milosevic case, the amicus curiae filed their "Reply to Confidential and Partly Ex Parte Prosecution’s Fourth Omnibus Motion for Leave to Amend the Witness List and Request For Protective Measures For Witnesses Named Therein Dated 31 October". On 7 November in The Prosecutor v. Blagojevic and Jokic, we received the "Prosecution’s Notice of Rule 94 bis Disclosure of Updated Dean Manning Report". On 7 November in The Prosecutor v. Radislav Krstic, we received from the Pre-Appeal Judge, Judge Meron, the "Decision on the Defence’s Motion to Submit Additional Authorities", in which Judge Meron granted the Motion. On the same day in the same case, an "Order" was rendered by Judge Meron requiring the Prosecution to file its response to the Defence "Supplemental Motion to Present Additional Evidence Pursuant to Rule 115" no later than Tuesday, 11 November 2003. On 11 November the Prosecution filed the "Motion for Additional Evidence". On 7 November in The Prosecutor v. Naletilic and Martinovic, we received from the Appeals Chamber (Judges Pocar, presiding, Shahabuddeen, Guney, Schomburg, and Weinberg De Roca) a "Decision on Joint Defence Motion by Enver Hadzihasanovic and Amir Kubura for Access to All Confidential Material, Filings, Transcripts and Exihibits in the Naletilic and Martinovic Case", in which the Appeals Chamber granted the Motion in part. The Decision is relatively long and complex, so I refer you to the text of the Decision. On 7 November in The Prosecutor v. Hadzihasanovic and Kubura, we received the "Defence Motion of Amir Kubura on Form of Indictment in Respect of New Charges Concerning Miletici". On 7 November in The Prosecutor v. Mitar Vasiljevic, before the Appeals Chamber we received the public version of the "Prosecution Respondent’s Brief". On 6 November in The Prosecutor v. Limaj, Bala and Musliu, we received the "Prosecutor’s Motion to Amend the Amended Indictment". On 31 October in The Prosecutor v. Mrksic, Radic and Sljivancanin, we received the "Defendant Veselin Sljivancanin’s Preliminary Motion". With regard to the court schedule and in addition to the ongoing trials: In The Prosecutor v. Momir Nikolic, the Sentencing Judgement will be rendered on 2 December 2003, commencing at 3 p.m. in Courtroom III. In The Prosecutor v. Dragan Nikolic, Trial Chamber II has ordered that the Sentencing Judgement in this case will be rendered on 18 December at 2 p.m. A reminder that in The Prosecutor v. Mitar Vasiljevic, the Appeal Hearing in this case will be held on Tuesday, 18 November 2003. The Appeal Hearing in The Prosecutor v. Radislav Krstic will now be held on 26 and 27 November and not on 24 and 25 November as previously scheduled. The Sentencing Hearing in The Prosecutor v. Ranko Cesic will be held on 27 and 28 November. The Pre-trial conference in The Prosecutor v. Radovan Stankovic will be held on 24 November. There will be a status conference in The Prosecutor v. Naser Oric on Tuesday 25 November 2003 commencing at 3 p.m. There will be a status conference in The Prosecutor v. Stanislav Galic this Friday, 14 November 2003, commencing at 2.15 p.m. in Courtroom III. Office of the Prosecutor: Florence Hartmann, Spokeswoman for the Office of the Prosecutor, made no statement. Questions: A journalist remarked that it would be interesting to get an update on the current status of Mr. Milosevic’s defence. Asked to confirm that the two associates, Mr. Tomanovic and Mr. Ognjanovic had access to Milosevic under conditions comparable to those for a defence lawyer, that they did not receive money from the Registry for their services and that Milosevic had not filed a request to the Registry to be considered as indigent, Landale replied that he was correct on all of those points except on one, which was that there were now three legal associates. Mr. Rakic also enjoyed that status and those privileges, he said. Asked why the Defence counsel was not represented in the press briefing as they had been over the last two weeks, Landale replied that they would be following after the briefing. He added that Stéphane Bourgon would then have the chance to take the table to announce anything he wished to announce and to answer questions. This was a Decision of the Registrar. Asked what Decision this was, Landale replied that the Registrar wanted the briefings to be structured in this way so that he and Florence representing official organs of the Tribunal would conduct their briefing in this manner and then the ADC and Stéphane had the opportunity to address the media after that. |
