SYLVAIN NSABIMANA
INTRODUCTION:
Sylvain Nsabimana was born on 29 July 1953 in Mbazi Commune, Butare prefecture, Republic of Rwanda. Betwwen 19 April 1994 and 17 June 1994, the accused was prefect of Butare.
Deferral Proceedings:
On 14 July 1997, the office of the prosecutor filed a request for transfer and provisional detention under Article 40 bis of the Rules of Procedure and Evidence of the International Criminal Tribunal for Rwanda, against Sylvain Nsabimana.The prosecutor`s request was heard on the 15 day of July 1997 by Judge Laity Kama who granted the orders sought. He was arrested on 16 July 1997 in Juja Farm Kenya in the ``NAKI operation`` (Nairobi - Kigali ) and in the same month transferred to Arusha Tanzania.
INDICTMENT:
The prosecutor of the International Criminal Tribunal for Rwanda filed an indictment on 14 October 1997 accusing Sylvain Nsabimana and another with Genocide, Direct and public incitement to genocide, Complicity in genocide, Crimes against humanity and Serious violations of article 3 common to the Geneva conventions and additional protocol II. The indictment was confirmed on 16 October 1997 by Judge Lennart Aspegren.
INITIAL APPEARANCE:
Sylvain Nsabimana appeared before Trial Chamber II of the International Criminal Tribunal for Rwanda, on the 24 day of October 1997. He pleaded not guilty to the Charges.
