Yesterday, the Committee of the Whole held an organizational meeting and later heard a report from the Working Group on Procedural Matters.  The Working Group on Procedural Matters on Part 6 (the trial) and the Working Group on International Cooperation and Judicial Assistance on Part 9 of the draft statute continued their work.

The discussions on Part 9 focussed on articles 87. Discussions were held on the notions of "surrender", "transfer" and "extradition of persons to the Court".  Different views were expressed.  It was noted that "extradition" refers to action between States and thus would not apply to an action between the States and the Court.  Thus, "surrender' would be more appropriate.  It was also stressed that the Conference was mandated to establish a sui generis institution and there was a need to abandon traditional ways of thinking, and to use terminologies not particularly associated with certain systems.

This morning, the Working Group on Part 9 continued its consideration of questions related to surrender, transfer and extradition (article 87) and article 90 on other forms of cooperation.  The Working Group on Procedural Matters spent the morning discussing "evidence" (article 69).
