Article 16
FREEDOM FROM VIOLENCE AND ABUSE

 

 

Canada

(1) "States Parties shall take all appropriate legislative, administrative, social, educational and other measures to protect persons with disabilities, in both private and public settings [DELETE within and outside the home], from all forms of exploitation, violence and abuse, including their gender-based manifestations [DELETE aspects]."
 
(5) "States Parties shall put in place effective legislation and policies, including gender- and children-sensitive [DELETE specific] legislation and policies, to ensure that instances of exploitation, violence and abuse against persons with disabilities are identified, investigated and, where appropriate, prosecuted."

 

Egypt, Morocco, Sudan, Syria, Saudi Arabia

1. DEL: "including their gender-based aspects" and replace it with "on a basis of equality of men and women."

2. Delete and replace it with Article 19 paragraph 1 of the CRC, "States Parties shall take all appropriate legislative, administrative, social and educational measures to protect the person with disabilities from all forms of physical or mental violence, injury or abuse, neglect or negligent treatment, maltreatment of exploitation, including sexual abuse, while in the care of parent(s), legal guardian(s) or any other person who has the care of the person with disability."

5. States Parties shall put in place effective legislation and policies to ensure that instances of exploitation, violence and abuse against persons with disabilities, on equal basis with others, are identified, investigated and prosecuted.

 

Russian Federation

Para 3 amend last phrase the following way: “are effectively monitored, including by independent authorities .
