What will be my filing status if I and my spouse are in a same sex marriage which is recognized by the state but not by the Federal government?

The Federal government does not recognize same sex marriage even though several states have recognized such marriage.  In this circumstance, for state income tax purposes, your filing status will be either married filing jointly or married filing separately.  For federal income tax purposes, your filing status will be either single, head of household or qualifying widow(er) depending on your particular situation.  Under this circumstance, the filing will be more complex and the UN encourages you to consult a qualified tax preparer or to use tax software for the preparation of your tax return.
